A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE EXECUTION
CF AN AGREEMENT WITH THE IRVINE COMPANY,
REGARDING OFF SITE.PARKING IN CONNECTION
WITH USE PERMIT 1406
WHEREAS, Irvine is the owner and developer of that
certain real property in the City of Newport Beach located
at the Southeast corner of Irvine Avenue and Mariners
Drive; and
WHEREAS, Irvine, under the terms of Use Permit
1406, is constructing an apartment complex in the C °0 °H
zone consisting of 114 units with a requirement of 228
parking spaces to be provided; and
WHEREAS, the required number of on site parking
spaces as set forth in the provisions of the zoning
ordinance and the terms of approval of Use Permit 1406,
are not available on site to the Irvine Company as
developers of the apartment project; and
WHEREAS, Irvine is also the sole owner of that
real property immediately contiguous to the proposed
apartment project and more commonly known as the Westcliff
Plaza Shopping Center; and
WHEREAS, Irvine has agreed that there shall be
reserved for the benefit of the residents of the apartment
project located northerly of the shopping center not less
than 38 parking spaces located on the parking lot of the
Westcliff Plaza Shopping Center; and
• WHEREAS, the Newport Beach Municipal Code allows
off street parking to be provided on a site other than
the building site on condition that an agreement between
the property owner and the City is executed and recorded

setting forth that the off-'street parking shall be
provided and maintained as a designated parcel of land
for the duration of the proposed use or uses on the
building site or sites;
MOW, THEREFORE., BE IT RESOLVED that the City
Council hereby approves said agreement wherein Irvine
shall provide 38 parking spaces located on the site of
the Westcliff Plaza Shopping Center for the use and
benefit of the residents of the apartment buildings
located northerly thereof; and the Mayor and City Clerk
are authorized and directed to execute the same on
behalf of the City;
BE IT FURTHER RESOLVED that the City Clerk
is authorized and directed to record said agreement
and execute any certificate necessary to accomplish
said recording.
