RESOLUTION NO. 6 9 4 0
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE EXECUTION
OF A PUBLIC WORKS CONTRACT FOR THE CONSTRUCTION
OF A BULKHEAD AT THE CITY -OWNED LIFEGUARD STATION
AT NEWPORT PIER, WITHOUT ADVERTISING FOR BIDS
WHEREAS, Section 1110 of the Charter requires every
project for the construction or improvement of public works to
be done by contract awarded to the lowest responsible bidder
after notice by publication; and
WHEREAS, said section contains an exception authorizing
a contract without advertising for bids where such work is deemed
by the City Council to be of urgent necessity for the preservation
of life, health or property, is authorized by resolution by five
affirmative votes of the Council, and contains a declaration of
the facts constituting the urgency; and
WHEREAS, during the period of time from March 1st
through March 10th, 1969, severe erosion of the beach in the
central Newport area of the City has occurred; and
WHEREAS, a major emergency effort involving the place-
meat of sand bags has been necessary in order to avert substantial
damage to the city -owned lifeguard facility fronting on the beach
in the central Newport area; and
WHEREAS, it is anticipated that continuing high tides
and strong ocean swells threaten to cause major property damage
to the lifeguard facilities; and
WHEREAS, the City Engineer has recommended to the City
Council that it take emergency action to construct a bulkhead
in front of the lifeguard facilities;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
of the City of Newport Beach that it finds such construction to
be of urgent necessity for the preservation of life, health and
property, and hereby authorizes the City Manager to accept
informal bids for the construction of a bulkhead in front of the
lifeguard facility on the ocean beach in the central Newport
area;
BE IT FURTHER RESOLVED that the City Manager is hereby
authorized and directed to execute a contract for said work.
This resolution was adopted by at least five (S)
affirmative votes of the City Council of the City of Newport Beach
at a meeting held on the 10th day of March, 1969, by the
following vote, to wit:
