HomeMy WebLinkAbout6985 - Prohibit Oil Exploration & Productionr t RESOLUTION NO. 6985 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH MEMORIALIZING THE CONGRESS OF THE UNITED STATES AND THE LEGISLATURE OF THE STATE OF CALIFORNIA TO ENACT LEGISLATION WHICH WOULD PROHIBIT OIL EXPLORATION AND PRODUCTION ON STATE AND FEDERAL TIDE AND SUBMERGED LANDS ADJACENT TO THE COAST OF CALIFORNIA BETWEEN THE NORTHERLY CITY LIMITS OF THE CITY OF NEWPORT BEACH AND THE MEXICAN BORDER WHEREAS, the California Legislature by the enactment of the Cunningham -Shell Tidelands Act of 1955, established an oil sanctuary on the tide and submerged lands controlled by the State extending from the northerly limits of the City of Newport Beach southerly to the Mexican border; and WHEREAS, at present there are no restrictions against exploration for or production of petroleum and other minerals from the submerged lands of the outer continental shelf under the jurisdiction and control of the United States Government, which are located seaward of the above described sanctuary area; and WHEREAS, the Cunningham -Shell Act would permit the State to authorize leases for the extraction of oil and gas on lands within said sanctuary area if it were determined that such lands were being drained from adjacent lands; and WHEREAS, this City Council strongly believes that it is in the best interests of the public that off -shore oil exploration and development be prohibited on both the State tide and sub- merged lands within the sanctuary established by the Cunningham - Shell Act and on the adjacent submerged lands controlled by the Federal Government; NOW, THEREFORE, BE IT RESOLVED by the City Council of • the City of Newport Beach that: The Congress of the United States and the Legislature of the State of California are hereby requested to enact appropriate legislation to accomplish the following results: 1. To absolutely prohibit any geological or geo- physical exploration work involving any physical penetration of the tide and submerged lands within the above described sanctuary area established by the Cunningham -Shell Act or on the adjacent federally controlled submerged lands. 2. To prohibit any leasing for exploration, develop- ment or removal of oil, gas or other minerals from the tide and submerged lands within the above described sanctuary area established by the Cunningham -Shell Act or on the adjacent federally controlled submerged lands unless it shall have first been determined by the appropriate State and Federal Agencies after public hearings that all of the following conditions exist: (1) oil, gas or mineral deposits are contained in said tide and submerged lands; (2) that said oil, gas or mineral deposits are being drained by means of wells or by other means from privately owned lands; and (3) that the leasing of said lands will be in the best interests of the governmental agency which owns said lands.
