• A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH ADVISING THE LOCAL AGENCY
FORMATION COMMISSION OF ORANGE COUNTY THAT THE
CITY COUNCIL OPPOSES DISSOLUTION OF THE ORANGE
COUNTY HARBOR DISTRICT, AND SUGGESTING THAT
THE COMMISSION STUDY CERTAIN SUGGESTED CHANGES
IN THE STRUCTURE AND JURISDICTION OF THE HARBOR
DISTRICT
WHEREAS, this City Council has previously expressed its
support for the fundamental objective sought by the Orange
County League of Cities, which is to integrate all County
regional recreation, including parks, harbors and beaches, into
a single comprehensive program in order to assure balanced
planning and development of recreational facilities and their
efficient administration; and
WHEREAS, the City Council has refrained from expressing
its opinion concerning the proposal to dissolve the Orange
County Harbor District until the other member cities of the
League of Orange County Cities had expressed their views on the
matter; and
WHEREAS, this City Council has withheld expressing its
views on this issue until this time for two reasons, the first
reason being that it initially appeared that the number of cities
favoring dissolution of the District was overwhelming, and secondly,
that because of the unique relationship between the City of
Newport Beach and the District, it was the Council's feeling that
any strong expression of opinion on its part at an early stage
in the discussion might have been misconstrued by the other
cities; and
• WHEREAS, it has become apparent that a unanimity of
opinion does not exist among the other cities of Orange County in
support of dissolution of the District; and

WHEREAS, through the years since the creation of the
District, the City of Newport Beach has had a unique vantage
point from which to observe the operations of the Harbor District
in Newport Harbor; and
WHEREAS, this City Council has been impressed by the
skillful manner in which the District has carried out its functions
in our City, and although there have been occasional disagreements
on jurisdictional questions, the City and the District have had a
highly successful working relationship; and
WHEREAS, the beautiful coastline, with its beaches and
harbors, is one of the great assets of our County; and
WHEREAS, the Orange County Harbor District has proven
its ability to do an excellent job in planning and developing
the coastline for the benefit of the public; and
WHEREAS, it is of utmost importance that our coastline
be developed for the benefit of the public while it is still
available for public acquisition, and a separate taxing agency
is the best method to assure the accomplishment of this objective;
and
WHEREAS, now that the other cities and interested
parties have expressed their views on this matter to the Local
Agency Formation Commission, the members of this City Council
feel an obligation to offer their views as to the best solution
for reconciling the divergent interests which will be affected by
the decision on the future of the Orange County Harbor District;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that:
1. We oppose the dissolution of the Orange County
Harbor District;
2. We request that the Local Agency Formation
Commission undertake a study for the purpose of determining how
the Orange County Harbor District could best be reorganized to

provide a comprehensive program of regional recreation, such
study to include the possibility of amending the Harbor Improve-
ment District Act to accomplish the following objectives:
(a) To expand the geographical territory covered
by the District to include the entire County;
(b) To increase the jurisdiction of the District
to include the planning, development and financing of County
parks, as well as County harbors and beaches, together with an
appropriate change in the name of the District to reflect its
broadened responsiblities;
(c) To re- examine the organizational structure of
the District in order to determine whether the County Board of
Supervisors should remain as the governing body with an appointed
advisory commission, or whether a new organizational arrangement
should be devised;
(d) To analyze the existing Harbor District
Improvement Act for the purpose of identifying and eliminating
jurisdictional conflicts between the District and cities which
have harbors within their city limits.
