A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH EXPRESSING ITS CONCERN ABOUT
THE THREAT TO PUBLIC HEALTH FROM AIR POLLUTION
AND URGING THE UNITED STATES ATTORNEY GENERAL
TO RECONSIDER THE ADVISABILITY OF THE DECISION
TO SETTLE THE ANTI -TRUST ACTION AGAINST THE
FOUR MAJOR DOMESTIC AUTO MANUFACTURERS WITHOUT
A TRIAL
WHEREAS, during the past 20 years the inhabitants of
Southern California have been faced with ever - increasing
amounts of air pollutants which have reached a level which
constitutes a serious threat to both human health and the
ecology of the area; and
WHEREAS, despite vigorous efforts by state and local
government which have caused a reduction in air pollution
emanating from industrial activities, air pollution emanating
from motor vehicle exhaust emissions has continued at an
unacceptable level; and
WHEREAS, the automobile industry has not been respon-
sive to the urgent need to develop effective anti -smog control
devices; and
WHEREAS, the United States Attorney General brought
suit against the four major automobile manufacturers for
conspiring, in violation of the Sherman Anti -Trust Act, to
restrain and delay the development and installation of smog
control devices pursuant to an indictment by a Federal Grand
Jury; and
WHEREAS, the Attorney General has agreed to settle the
case out of court by means of a Consent Decree; and
WHEREAS, unless the anti -trust suit is brought to
trial the results of the Grand Jury investigation will remain
secret;

NOW, THEREFORE, BE IT RESOLVED by the City Council
Sider the advisability of settling the anti -trust suit without
trial, and to explain the position of the Department of
Justice.
ADOPTED this 13th day of October, 1969.
