A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, CALLING AND
GIVING NOTICE OF A SPECIAL MUNICIPAL ELECTION
• TO BE HELD IN SAID CITY ON TUESDAY, JANUARY 13,
1970, FOR THE PURPOSE OF SUBMITTING TO THE
QUALIFIED VOTERS OF SAID CITY A MEASURE RELATING
TO THE LEASING OF CITY OWNED PROPERTY
WHEREAS, Section 420 of the Newport Beach City Charter
provides that the City Council shall not have the power to
approve any lease or extension thereof for a longer period than
twenty -five years unless said lease or extension be approved by
a majority of the qualified electors of the City voting on such
question at an election; and
WHEREAS, the Balboa Bay Club, Incorporated, a California
corporation, is the lessee of a parcel of City -owned real property
located on the southerly side of Pacific Coast Highway just
easterly of the southerly prolongation of Irvine Avenue in the
City of Newport Beach; and
WHEREAS, the term of the existing lease between the
City and the Balboa Bay Club, Incorporated, will expire on
October 31, 1998; and
WHEREAS, representatives of the Balboa Bay Club, Incor-
porated, have requested that the City Council approve an amended
lease which would extend the term of the lease to a total of
fifty -five years and provide for an increase in rental payable
to the City; and
WHEREAS, the City Council and the representatives of
the Balboa Bay Club, Incorporated, have reached agreement on the
proposed terms of an amended lease which the City Council wishes
to submit to the qualified electors of the City;
NOW, THEREFORE, the City Council of the City of Newport
Beach DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER, as

follows:
SECTION 1. That a special election be held and the
same is hereby called to be held in said City on January 13,
• 1970, for the purpose of submitting to the qualified voters of
said City a measure hereinafter set forth relating to the
leasing of City -owned real property.
SECTION 2. That the proposition submitted to the
voters shall be as follows:
"SHALL THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH BE AUTHORIZED TO ENTER INTO
AN AMENDED LEASE WITH THE BALBOA BAY CLUB
WHICH WOULD EXTEND THE TERM OF THE EXISTING
LEASE FROM 28 YEARS TO 55 YEARS ?"
SECTION 3. That the polls for said election shall be
opened at 7 :00 a.m. of the day of said election and shall remain
open continuously from said time until 7 :00 p.m. of the same day,
when said polls shall be closed, except as provided in
Section 14436 of the Elections Code of the State of California.
SECTION 4. That on the ballots to be used at said
special election, in addition to any other matters required by
law, there shall be printed substantially the following:

: ENTER INTO AN AMENDED LEASE WITH
: THE BALBOA BAY CLUB WHICH WOULD

SECTION 5. That a cross ( +) placed in the voting square
after the word "YES" in the manner hereinbefore provided shall
be counted in favor of the adoption of the proposition. A cross ( +)
0 placed in the voting square after the word "NO" in the manner here-
inbefore provided shall be counted against the adoption of the

proposition.
SECTION 6. That notice of the time and place of
holding said election is hereby given and the City Clerk is
hereby authorized, instructed and directed to give such further
or additional notice of said election in time, form and manner
as required by law.
ADOPTED this 17th day of November, 1969.
