Eat Chow Outdoor Dining Minor Use Permit No. UP2013 -005 (PA2013 -034) 211 62nd Street Council District 2 Summary: This item was continued from the April 11, 2013 Zoning Administrator meeting. The application is to amend a use permit to allow four seats (50 square feet) for the addition of an outdoor dining area at an existing eating and drinking establishment approved by Use Permit No. UP2010 -027 (PA2010 -136). The applicant has withdrawn the application, therefore the provisions of the existing use permit shall remain in place. Recommended Action: 1) No action required. Application withdrawn by applicant. Item No. 2. 424 Marguerite Avenue Parcel Map No. NP2013 -008 (PA2013 -060) 424 Marguerite Avenue Council District 6 Summary: A tentative parcel map application for condominium purposes. No waivers of Title 19 (Subdivision Code) development standards are proposed with this application. An existing single - family residence will be demolished and replaced with a proposed two -unit duplex that will provide the code required two -car parking per unit. The parcel map is for the purpose of allowing each unit of the proposed duplex to be sold individually. The property is located in the R -2 (Two -Unit Residential) District. This hearing is subject to the Ralph M. Brown Act. Among other things, the Brown Act requires that the Zoning Administrator's agenda be posted at least seventy -two (72) hours in advance of each regular hearing and that the public be allowed to comment on agenda items before the Zoning Administrator and items not on the agenda but are within the subject matter jurisdiction of the Zoning Administrator. The Zoning Administrator may limit public comments to a reasonable amount of time, generally three (3) minutes per person. It is the intention of the City of Newport Beach to comply with the Americans with Disabilities Act ( "ADA ") in all respects. If, as an attendee or a participant at this hearing, you will need special assistance beyond what is normally provided, the City of Newport Beach will attempt to accommodate you in every reasonable manner. If requested, this agenda will be made available in appropriate alternative formats to persons with a disability, as required by Section 202 of the Americans with Disabilities Act of 1990 (42 U.S.C. Sec. 12132), and the federal rules and regulations adopted in implementation thereof. City of Newport Beach Zoning Administrator Agenda May 16, 2013 Recommended Action: CEQA Compliance: Item No. 3. 1) Conduct public hearing; and 2) Adopt Resolution No. _ approving Tentative Parcel Map No. NP2013 -008 subject to the recommended findings and conditions. The project qualifies for a Class 15 (Minor Land Divisions) categorical exemption pursuant to Title 14 of the California Code of Regulations (Section 15315, Article 19 of Chapter 3, Guidelines for Implementation of the California Environmental Quality Act). 1200 W. Ocean Front Lot Line Adjustment No. LA2013 -003 (PA2013 -062) 1200 W. Ocean Front Council District 1 Summary: A lot line adjustment application to adjust the underlying lot line between two contiguous lots. The applicant is requesting to shift the interior lot line 3 -feet to the northwest. Land taken from Lot 2 will be added to Lot 1. There will be no change in the number of lots. The property is located in the R -1 (Single -Unit Residential) District. n .uu -@=0 Action: 1) Conduct public hearing; and 2) Adopt Resolution No. _ approving Lot Line Adjustment No. LA2013 -003 subject to the recommended findings and conditions. CEQA Compliance: The project qualifies for a Class 5 (Minor Alterations in Land Use Limitations) categorical exemption pursuant to Title 14 of the California Code of Regulations (Section 15305, Article 19 of Chapter 3, Guidelines for Implementation of the California Environmental Quality Act). Item No. 4. West Marine Signs — Modification Permit No. MD2013 -007 and Comprehensive Sign Program No. CS2013 -006 (PA2013 -056) 3425 Via Lido Council District 1 Summary: In conjunction with the installation of four tenant identification signs on a single - tenant building, the applicant is requesting approval of a comprehensive sign program to establish design parameters for the wall signs. A modification permit is also required to allow an increase in the size and height associated with two of the proposed wall signs. The property is located in the CG (Commercial General) District. Recommended Action: 1) Conduct public hearing; and 2) Adopt Resolution No. _ approving Modification Permit No. MD2013 -007 and Comprehensive Sign Program No. CS2013 -006 subject to the recommended findings and conditions. CEQA Compliance: The project is categorically exempt under Section 15311, of the California Environmental Quality Act (CEQA) Guidelines - Class 11 (Accessory Structures). Item No. 5. New Freestanding Commercial Monument Signs - Modification Permit No. MD2013- 003 (PA2013 -040) 143, 151, and 951 Newport Center Drive Council District 1 REV: 03 -06 -13 City of Newport Beach Zoning Administrator Agenda May 16, 2013 Summary: A Modification Permit to allow three new, freestanding commercial monument signs to exceed the maximum height allowed by the sign standards for the Fashion Island sub -area of the North Newport Center Planned Community (PC 56). The proposed signs are 6 feet high (5 feet is permitted), have a sign area of 36.90 square feet (50 square feet is permitted), and a maximum letter /logo height of 4.5 feet (4.5 feet is permitted). One freestanding monument sign will be located at the closest point of access from Newport Center Drive for each of the following properties: 143 (Red O Restaurant - Pad "C "), 151 (Fig and Olive Restaurant — Pad "B "), and 951 (no tenant — Pad "D ") Newport Center Drive. The property is located in the PC -56 (North Newport Center) District. Recommended Action: 1) Conduct public hearing; and 2) Adopt Resolution No. approving Modification Permit No. MD2013 -003 subject to the recommended findings and conditions. CEQA Compliance: The project is categorically exempt under Section 15311, of the California Environmental Quality Act (CEQA) Guidelines - Class 11 (Accessory Structures). D) PUBLIC COMMENTS ON NON - AGENDA ITEMS Public comments are invited on non - agenda items generally considered to be within the subject matter jurisdiction of the Zoning Administrator. Speakers must limit comments to three (3) minutes. Before speaking, we invite, but do not require, you to state your name for the record. The Zoning Administrator has the discretion to extend or shorten the speakers' time limit on non - agenda items, provided the time limit adjustment is applied equally to all speakers. As a courtesy, please turn cell phones off or set them in the silent mode.
