HomeMy WebLinkAbout7291 - Annexation 71 - Acacia-Palisadesc RESOLUTION NO. 7 2 9 1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH GIVING NOTICE OF PROCEEDINGS INITIATED BY WRITTEN PETITION REQUESTING THE • ANNEXATION TO THE CITY OF NEWPORT BEACH OF CERTAIN UNINHABITED TERRITORY KNOWN AS THE ACACIA - PALISADES ANNEXATION - ANNEXATION NO. 71, AND SETTING A DATE FOR HEARING PROTESTS TO SAID ANNEXATION WHEREAS, on the 27th day of May, 1970, the Local Agency Formation Commission of Orange County adopted a resolution approving the proposed annexation to the City of Newport Beach of certain uninhabited territory, as hereinafter described, said proceeding to be known as the Acacia - Palisades Annexation - Annexation No. 71; and WHEREAS, a written petition requesting annexation of said territory has been filed with the City Council, signed by the owners of not less than one - fourth of the land in the territory by area, and by assessed value as shown on the last equalized assessment roll of Orange County; NOW, THEREFORE, the City Council of the City of Newport Beach HEREBY RESOLVES as follows: 1. Proceedings are hereby initiated for the annexation to the City of Newport Beach of the following described uninhabited territory: A parcel of land lying within Tract No. 706 as shown on a map thereof, recorded in book 21, page 25 of Miscellaneous Maps, records of Orange County, California, more particularly described as follows: Beginning at a point in the center line of Campus Drive (formerly Acacia Street) said point being on the north- westerly prolongation of the southwesterly line of Tract No. 3201 as shown on a map thereof, recorded in book 130, pages 25 through 29 of Miscellaneous Maps, records of said Orange County, said point also being an angle point in the existing boundary of the City of Newport Beach being the • most westerly corner of Annexation No. 56, Ordinance No. 1116, adopted by the City Council of the City of Newport Beach, -1- 0 • • • February 8, 1965; thence South 500 11' 45" East, 330.00 feet along said existing boundary as described in said annexation No. 56 and as described in the Acacia Street Annexation, Ordinance No. 837, adopted by the City Council of the City of Newport Beach, October 28, 19576 thence departing from said existing boundary South 39 48' 15" West, 1370.00 feet along the northeasterly prolongation of the southeasterly line, the southeasterly line and the southwesterly prolongation of the southeasterly line of Lots 72 through 79 and Lot 81 of said Tract No. 706 to the center line of Orchard Drive; thence North 500 11' 45" West, 330.00 feet, along said center line, to the center line of Acacia Street, as shown on said Tract No. 706; thence North 390 48' 15" East, 1370.00 feet along said center line of Acacia Street to the Point of Beginning. 2. Notice is hereby given that the City Council will hold a hearing for the purpose of considering written protests against said annexation, made by any person owning real property within the territory proposed to be annexed, on the 23rd day of November, 1970, at the hour of 7;30 p.m. in the City Council Chambers located within the City Hall, 3300 Newport Boulevard, Newport Beach, California, which date of hearing is not less than 40 nor more than 60 days after the passage of this resolution. 3. The City Clerk is directed to cause a copy of this resolution to be published at least twice, but not more often than once a week, in the Newport Harbor Ensign, a newspaper of general circulation published in the City, and also in the Daily Pilot, a newspaper of general circulation published outside of the City but in the County in which is located the territory proposed to be annexed, publication to be completed at least 20 days prior to the date set for the hearing. The City Clerk shall send a copy of this resolution to the governing board of any school district which, in part or in whole, is included in the territory sought to be annexed and which has made written request therefor. The City Clerk is further directed to cause written notice of such proposed annexation to be mailed to each -2- . person to whom land within the territory proposed to be annexed is assessed in the last equalized County assessment roll available • on the date proceedings were initiated, at the address shown on said assessment roll, or as known to said City Clerk, and to any person who has filed his name and address and the designation of the lands in which he has any interest, either legal or equitable, with said Clerk. Said notices shall be given not less than 20 days before the first public hearing on the proposed annexation. ADOPTED this 28th day of September, 1970, 'f-r/ "-:e ;;4".
