A RESOLUTION OF THE CITY COUNCIL OF THE CITY
• OF NEWPORT BEACH STATING THE POLICY OF THE
COUNCIL CONCERNING THE FREEWAY AGREEMENT
BETWEEN THE CITY OF NEWPORT BEACH AND THE
STATE OF CALIFORNIA AS IT RELATES TO THAT
PORTION OF THE ROUTE 1 (PACIFIC COAST)
FREEWAY BETWEEN THE NEWPORT BEACH CITY LIMIT
NEAR BUCK GULLY AND BAYSIDE DRIVE
WHEREAS, on October 28, 1968, the Newport Beach City
Council adopted Resolution No. 6890 approving a freeway agreement
with the State of California, which agreement purported among
other things to consent to the closure of city streets, relocation
of city streets, construction of frontage roads and other local
roads, and other construction affecting city streets to accommodate
the construction of the Route 1 Pacific Coast Freeway between the
easterly city limits near Buck Gully in Corona Del Mar and Bayside
Drive; and
WHEREAS, with the passage of time since the approval of
said freeway agreement it has become evident to the City Council
that the construction of a freeway along the adopted route between
Bayside Drive and Corona Del Mar is absolutely unacceptable to
the residents of the City; and
WHEREAS, at a special election held on March 9, 1971,
the voters of the City overwhelmingly approved a ballot proposition
which mandates this Council to rescind that portion of the freeway
agreement relating to the previously described segment of the
Pacific Coast Freeway; and
WHEREAS, this Council intends to appoint a negotiating
committee to meet with representatives of the State to explore the
subject of mutual rescission of the above described portion of the
freeway agreement; and
WHEREAS, the mandate of the people clearly requires
rescission action;

NOW, THEREFORE, BE IT RESOLVED AND ORDERED by the City
Council of the City of Newport Beach, as follows:
1. The following members of the City Council are
appointed to serve as members of the City Council Freeway Nego-
tiating Committee for a period not to exceed 60 days:
Vice Mayor Howard Rogers
Councilman Donald McInnis
2. The City Council will unilaterally rescind the
existing freeway agreement as described above within 60 days in
the event that a mutually agreeable bilateral rescission agreement
is not achieved;
3. The Freeway Negotiating Committee is authorized to
represent the City Council in any and all negotiations with
representatives of the State of California concerning rescission
of the freeway agreement;
4. The Freeway Negotiating Committee shall keep the
other members of the Council fully informed concerning the progress
of the negotiations.
