A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH DECLARING ITS INTENTION TO
ORDER THE CLOSING UP, VACATION AND ABANDONMENT
OF PORTIONS OF BAYSIDE DRIVE, WESTERLY OF
JAMBOREE ROAD
The City Council of the City of Newport Beach, pursuant
to the provisions of the "Street Vacation Act of 1941", and all
amendments thereto, being Sections 8300 to 8331, inclusive, of
the Streets & Highways Code of the State of California, DOES
HEREBY RESOLVE AND DECLARE as follows:
SECTION 1. The public interest and convenience require
the closing up and abandonment of portions of Bayside Drive,
westerly of Jamboree Road, in the City of Newport Beach, and it
is the intention of the City Council of the City of Newport Beach
to order the following described portions of said street in the
City of Newport Beach, County of Orange, State of California, to
be vacated, closed up and abandoned, to wit:
PARCEL 1
That portion of Block 94 of Irvine's Subdivision, as
shown on a map recorded in Book 1, page 88 of Miscellaneous
Record Maps, in the office of the County Recorder of Orange
County, California, described as follows:
BEGINNING at a point in the southerly right -of -way line
of Bayside Drive, as described in a deed to the County of
Orange recorded in Book 830, page 217 of Official Records of
said Orange County, said point being distant along said
southerly right -of -way line and its westerly prolongation,
South 84 °46'33" East, 1170.60 feet from a 1 -1/2 inch pipe
and mail designated "Station 8" on a map of Tract 4003,
recorded in Book 188, pages 13 through 19, inclusive, of
Miscellaneous Maps, records of said Orange County; thence
leaving said southerly right -of -way line North 5 °13127" East,
60.00 feet to the TRUE POINT OF BEGINNING; thence continuing
North 5 °13127`° East, 9.30 feet to a point in a non - tangent
curve, concave northwesterly, having a radius of 100.00 feet,
a radial line from said point bears North 19 °411110" West,
thence northwesterly 15.69 feet along said curve through a
central angle of 8 °59228" to a line parallel with and distant
77.00 feet, northerly as. measured at right angles from said
southerly right -of -way line of Bayside Drive; thence South
84 °46833" East, 82.39 feet along said parallel line to the
beginning of a non - tangent curve, concave southeasterly,

having a radius of 108.00 feet, a radial line from said
point bears South 18 °19355" East; thence southwesterly
11.57 feet along said curve through a central angle of
6 °08'15" to a point of reverse curvature with a curve,
concave northwesterly, having a radius of 90.00 feet, a
radial line from said point bears North 24 °28310" West;
thence southwesterly 46.64 feet along said curve,through
a central angle of 29 °41'37" to a line parallel with and
distant 60.00 feet, northerly as measured at right angles
from said southerly right -of -way line of Bayside Drive;
thence North 84 046233" West, 41.13 feet along said parallel
line to the TRUE POINT OF BEGINNING.
CONTAINING: 0.029 acres, more or less, gross.
PARCEL 2
That portion of Block 94 of Irvine's Subdivision, as
shown on a map recorded in Book 1, page 88 of Miscellaneous
Record Maps, in the office of the County .Recorder of Orange
County, California, described as follows:
BEGINNING at an angle point in the southerly right -of-
way line of Bayside Drive, as described in a deed to the
County of Orange recorded in Book 830, page 217 of Official
Records of said Orange County, said point being distant
along said southerly right -of -way line and its westerly
prolongation, South 84 °46333" East, 1569.68 feet from a
1 -1/2 inch pipe and nail designated "Station 8" on a map of
Tract No. 4003, recorded in Book 188, pages 13 through 19,
inclusive, of Miscellaneous Maps, records of said Orange
County; thence along said southerly right -of -way line South
84 048156" East, 367.61 feet to a non - tangent curve, concave
northeasterly and having a radius of 855.00 feet, a radial line
from said point bears North 11 °23'07" East; thence northwesterly
along said curve 3.12 feet, through a central angle of
0012333" to the TRUE POINT OF BEGINNING of this description;
thence continuing along said curve 281.87 feet through a
central angle of 18 °53220" to a non - tangent line parallel
with and distant 77.00 feet, northerly as measured at right
angles from said southerly right -of -way line; thence along
said parallel line North 84 °48856" West, 67.89 feet to a non -
tangent curve, concave northeasterly and having a radius of
892.00 feet, a radial line from said beginning bears North
29 °09157" East; thence southeasterly along said curve 348.61
feet through a central angle of 22 °23333" to the TRUE POINT OF
BEGINNING.
CONTAINING: 0.100 acres, more or less, gross.
Those portions of said street to be vacated, closed up and
abandoned are more clearly shown on a certain map approved and
• adopted by the City Council of the City of Newport Beach for said
vacation, closing up and abandonment, by resolution dated
April 10 , 1972, and designated Resolution No. 7668 ,

which said map is on file in the office of the City Clerk of
the City of Newport Beach. Reference is hereby made to said
map for further particulars as to the proposed vacation, closing
extent and purpose as if it were incorporated herein in full.
SECTION 2. The proceedings for the closing up and
abandonment of the aforesaid portions of said street shall be
had and taken, and the City Council of the City of Newport Beach
hereby elects to proceed under the provisions of the "Street
Vacation Act of 1941 ", and all amendments thereto, being
Sections 8300 to 8331 inclusive, of the Streets & Highways Code
of the State of California.
SECTION 3. The Street Superintendent of the City of
Newport Beach shall cause to be conspicuously posted along the
line of the portions of said street proposed to be vacated not
more than 300 feet apart, but not less than three in all, notices
of the vacation of said portions of said street. Said notices
shall state the passage of this Resolution and the time and place
of the hearing of all persons interested in or objecting to the
proposed vacation of said portions of said street. Said notices
shall be so posted at least ten (10) days before the date of said
hearing, all as required by law.
SECTION 4. There is hereby reserved and excepted from
the vacation of said portions of said street a permanent easement
for public utility purposes over and across Parcel 2 of those
portions of said street proposed to be vacated and set forth in
Section 1 hereinabove. These vacation proceedings are taken
subject to the resey.vations and exceptions herein contained, as
to said Parcel 2.
SECTION 5. Notice is hereby given that the City Council

is
made a part
of
this
resolution by reference
to the same
extent and purpose as if it were incorporated herein in full.

day of May 1972, at the hour of 7 :30 p.m. of said
day, in the Council Chambers of the City of Newport Beach, located
in the City Hall, as the time and place for hearing all persons
interested in or objecting to the proposed vacation of said
portions of said street hereinbefore described.
SECTION 6. This resolution shall be published at least
once in the official newspaper of the City, and said publication
shall be made before the date set for the hearing of all persons
interested in or objecting to the proposed vacation.
