RESOLUTION NO. 7785
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AMENDING RESOLUTION NO. 7106
TO ALLOW EARLIER MORNING SURFING IN SURFING
AREA NO. 1 FOR A TRIAL PERIOD
WHEREAS, Sections 11.16.020 and 11.16.040 of the
Newport Beach Municipal Code authorize the City Council to
designate certain areas of the Pacific Ocean where surfing
shall be permitted, specify the dates and hours when such
surfing areas may be used for surfing, and regulate the use
of surfing areas by swimmers; and
WHEREAS, by Resolution No. 7106 dated December 3,1969,
the City Council designated the following surfing areas and
the dates and hours when such areas may be used for surfing:
(a) Surfing Area No. 1. That area between the
southerly extension of the easterly line of 19th Street and
the westerly boundary of the City;
(b) Surfing Area No. 2. That area between a line
parallel to and two hundred (200) feet easterly of the East
Jetty and a line parallel to and twenty (20) feet easterly of
the East Jetty;
(c) Surfing Area No. 3
Little Corona Beach;
and
That area commonly known as
WHEREAS, surfing is permitted in Surfing Area Nos. 2
and 3 between the hours of 6:00 a.m. and 12:00 noon and 2:00 p.m.
and sunset, and in Surfing Area No. 1 between the hours of
7:30 a.m. and 12:00 noon and 4:00 p.m. and sunset, all subject
to discretionary closure under certain conditions; and
WHEREAS, the City Council has received a request to
allow surfing to commence at 6:00 a.m. in Surfing Area No. 1;
and
WHEREAS, the City Council has determined that it
would be in the public interest to change the surfing hours

as requested, for a trial period, subject to certain conditions, for
the purpose of studying the general effect of such change, in con-
nection with noise and general nuisance problems which may arise;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that Paragraph (a), Section 2, of said
Resolution No. 7106 is hereby amended to read:
"(a) In Surfing Area No. 1, surfing shall be permitted
daily between the hours of 6 :00 a.m. and 12 :00 noon, and between
the hours of 4:00 p.m, and sunset, from August 22 to September 15,
1972, except that if complaints are received from residents in the
area that the peaceful enjoyment and use of their property is being
disturbed by noise, general behavior or other similar nuisances,
the morning surfing hours of 7:30 a.m. till 12:00 noon will im-
mediately be reinstated and will remain in effect at the discre-
tion of the City Council; said surfing periods will be subject
to discretionary closure at any time during said periods, pursuant
to Sections 11.16.060 and 11.16.070 of the Municipal Code, as
indicated by use of the blackball signal flag system. In addition,
the City Manager, upon the recommendation of the Marine Safety
Director, may approve the opening of an area not to exceed one
block in width within Surfing Area No. 1 from 7:30 a.m. until
sunset on specified days for purposes of surfing contests or other
special events."
BE IT FURTHER RESOLVED that the City staff is directed
to maintain a record of all complaints received and problems en-
countered in connection with permitting surfing to commence at the
earlier morning hour in Surfing Area No. 1, for the August 22 to
September 15, 1972 period, in order to determine if it would be
feasible to continue the 6:00 a.m, commencing time on a permanent
basis.
