RESOLUTION NO. 7983
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH EXPRESSING ITS
OPPOSITION TO PUBLIC EMPLOYER- EMPLOYEE
RELATIONS LEGISLATION
WHEREAS, the City Council of the City of Newport
• Beach favors the existing practice of public agency employer-
employee relations which allows for meeting and conferring
with recognized employee organizations in good faith to re-
solve any conflicts and reach agreements on matters of wages,
hours and working conditions; and
WHEREAS, various bills have been introduced among
which are SB 32 (Dills), AB 485 (McCarthy), SB 522 (Berryhill)
and AB 1243 (Moretti) which if enacted would completely under-
mine and disrupt the public employer- employee relations at
the local level; and
WHEREAS, said bills would, among other things,
create a new level of government by establishing independent
boards and commissions to administer employer - employee rela-
tions; give public employees the right to form, join or assist
any employee organization to bargain collectively, and to
strike; provide for methods of settlement of disputes by
mediation, factfinding and binding arbitration; and
WHEREAS, such labor practices are totally inconsis-
tent with the fundamental principle of home rule and the civil
service system as mandated by the citizens of the City of
Newport Beach in the Newport Beach City Charter, and could
seriously jeopardize the health, safety and general welfare
of the taxpaying public who have a right to rely on municipal
services not being interrupted or curtailed.
NOW, THEREFORE, BE IT RESOLVED that the City Council
• of the City of Newport Beach hereby expresses adamant opposi-
tion to any employer - employee relations legislation that would
conflict with the meet and confer process which has proven to

be the most equitable method of insuring the highest quality
of public employment while at the same time protecting the
rights of local citizens.
BE IT FURTHER RESOLVED that the City Clerk is hereby
authorized and instructed to transmit certified copies of this
resolution to Senator Dennis E. Carpenter, Assemblyman Robert
E. Badham, the League of California Cities, the Assembly Com-
mittee on Employment and Public Employees, the Senate Committee
on Public Employment and Retirement, and all of the Cities in
Orange County.
