Condition No. 8 requires the applicant post a surety bond for the completion of the building shell. The applicant requests the waiver of the requirement. RECOMMENDATION: 1. Conduct a public hearing; 2. Find that the proposed amendment is not subject to the California Environmental Quality Act (CEQA) pursuant to Section 15061.b.3 of the CEQA Guidelines; and 3. Adopt the attached resolution waiving Condition No. 8 imposed by City Council Resolution No. 2009 -52. FUNDING REQUIREMENTS: None. 1 Waiver of Condition No. 8 for "AERIE" Project September 10, 2013 Page 2 DISCUSSION: Condition No. 8 of Council Resolution No. 2009 -52, is as follows: 8. Prior to the issuance of a grading or building permit, the applicant shall provide the City with a performance bond or its equivalent to ensure timely completion of all improvements represented on plans and drawings submitted for permit approval in the event construction of improvements consistent with project approval is abandoned. The performance bond or its equivalent shall be an amount equal to 100% of the cost of completing project improvements from the start of grading activities up to completion of the building shell and shall be issued with the City as beneficiary by an insurance company currently authorized by the Insurance Commissioner to transact business of insurance in the State of California and shall have an assigned policyholders' Rating of A (or higher) and Financial Size Category Class VII (or larger) in accordance with the latest edition of Bests Key Rating Guide unless otherwise approved by the City Risk Manager. The bond or equivalent shall be released in 25% increments upon completion of each quarter of construction of the building shell. The City Council included the condition above based on the recommendation of the Planning Commission when the project included more extensive excavation of the bluff (over 32,000 cubic yards of excavation). There was a concern that should the project be abandoned while under construction, the bond would allow the City to complete the building shell and mitigate a potential nuisance. Subsequent to the City's approval, the Coastal Commission scaled back the scope of the project considerably requiring a little more than 9,000 cubic yards of excavation. The applicant believes the requirement is an unnecessary and costly burden not applied to other private projects. The City routinely requires bonds for the completion of public infrastructure, but not for the completion of private development. The applicant further believes that his construction financing will provide sufficient surety that the entire project will be completed. Documentation submitted by the applicant is provided in Attachment CC 2. Staff concurs with the applicant's claims that requiring a bond for private development has not been the City's practice. Therefore, it is recommended that the condition of approval be waived. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action not subject to covered by the California Environmental Quality Act (CEQA) by the general rule that only applies CEQA to projects 2 Waiver of Condition No. 8 for "AERIE" Project September 10, 2013 Page 3 that have the potential for causing a significant effect on the environment (Section 15061.b.3 of the CEQA Guidelines). It can be seen with certainty that there is no possibility that the waiver of Condition No. 8 requiring a bond for the completion of the AERIE building shell will have a significant effect on the environment as the condition in question does not involve any physical aspect of the previously approved project. It should also be noted that the City previously certified an Environmental Impact Report for the AEIRE project. NOTICING: Notice was published in the Daily Pilot, on the City's website, mailed to property owners within 300 feet of the project site, and posted at the site a minimum of 10 days in advance of this hearing, which is consistent with the Municipal Code. Additionally, the item was shown on the agenda for this meeting, which was posted at City Hall and on the City website. A public hearing was held on September 10, 2013, in the Council Chambers at 100 Civic Center Drive, Newport Beach. A notice of time, place and purpose of the meeting was given in accordance with the Newport Beach Municipal Code. Evidence, both written and oral, was presented to, and considered by, the City Council at this meeting. SECTION 2. Suite 100 Irvine, CA 92618 Broker License # 00881503 August 5, 2013 Mr. James Campbell City of Newport Beach 100 Civic Center Drive Newport Beach, CA 92660 Dear Jim: Now that the AERIE project has been approved by the California Coastal Commission and is moving toward construction we have been working on resolving several of the loose ends and tasks that have taken place during the 10+ years of entitlements. One of the agreements that we made with the Planning Commission several years ago when the proposed project was significantly larger, was to post a bond for completion of the shell. At that time the project extended down +51 feet below the street level at elevation 19.25, and contemplated an excavation of 32,400 cubic yards of material from the site. Since some neighbors at the time expressed concerns about the excavation, discussions turned towards the "what ifs" relative to potential problems that could occur with digging a hole that deep. We agreed to posting a bond in order to allay any concerns relative to a possibly unfinished hole. This was memorialized as Condition of Approval #8. As the plan has progressed through the years, excavation has been drastically reduced in size and scope to where that concern is no longer founded. The final California Coastal Commission approved version of AERIE includes excavation that will only proceed down 22 feet to elevation 48.7, the building pad, and only 9,810 cubic yards of removal from the site are required. This excavation is less than a third of what was anticipated at the time that the bond was suggested. Since the amount of excavation is within the normal parameters for a site of this size, we feel that the expensive and hard to obtain bond is onerous and unnecessary. Research shows that such a bond requirement has not been imposed on any other private property developments in the City. This would be setting a new precedence that could thrust the City into having to finish any future stalled projects. It is also unclear as to how the City could even complete the improvements if construction stopped as most likely there would be pending litigation, bankruptcy etc. In reality, Condition #8, with the unclear language relative to a "shell" does not really specify how the project is to even be finished. The provisions invoked by our construction lender gives far more assurances that AERIE will be built to full completion. FIRM We respectfully request that in fairness, condition #8 to the project be eliminated so that we are not required to post the bond. As an additional inducement to the City in appreciation for removal of the bond, AERIE would be willing to relocate the sewer in front of our project out into the street and undergrounding the utilities currently supported by the unsightly telephone poles, all of which is currently being planned by Public Works. With some of the savings from the bond exemption we can absorb this cost of relocation of the sewer, and not ask for a reimbursement when the City proceeds, as is planned, with the relocation of the sewers in the area. We hope that you will consider this as a fair exchange since the need for the bond is no longer applicable. We'd much rather see the money go into an improvement to the City rather than unnecessarily to a bonding company. We look forward to your thoughts in this regard.
