Brown, City Clerk 949 - 644 -3005, (brown @ne PREPARED APPOINTMENT OF NEW CITY ARTS COMMISSIONERS TO FILL TWO UNSCHEDULED VACANCIES ABSTRACT: Due to the recent resignations on the City Arts Commission, the City Council may appoint new members pursuant to City Council Policy A -2 (Board, Commission and Committee Appointments) and Charter Section 702 (Appointment. Terms.). RECOMMENDATION: Appoint two people from the applicant list provided in the staff report to the City Arts Commission to fill the unexpired balance of Gilbert Lasky's term which expires on June 30, 2014, and Carole Boller's term which expires on June 30, 2017. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DISCUSSION: At the August 8, 2013 City Arts Commission meeting, Commissioner Gilbert Lasky resigned his seat on the City Arts Commission. His second term was scheduled to expire on June 30, 2014. On August 12, 2013, City Arts Commissioner Carole Boller submitted a letter of resignation to her seat on the City Arts Commission. She was recently reappointed to the Commission for her second term on June 25, 2013. Her term was scheduled to expire on June 30, 2017. Appointment of New City Arts Commissioners September 10, 2013 Page 2 Pursuant to Charter Section 702 and City Council Policy A -2, the City Council's appointees to the City Arts Commission will serve both Mr. Lasky's and Ms. Boller's unexpired terms, respectively. Pursuant to the Maddy Act and City Council Policy A -2, the City Clerk prepared and posted a Notice of Unscheduled Vacancies on Monday, August 12, 2013 in the City Clerk's Office, at the Central Library, and on the bulletin board in the City Council Chambers. The Notice was also placed on the City's webpage on Monday, August 12, 2013, and was published in the Daily Pilot on Saturday, August 17, 2013. As per the Notice, applications were accepted by the City Clerk's Office until noon on Friday, August 30, 2013. The following is a list of qualified applicants who desire to be considered for the current unscheduled vacancies on the City Arts Commission: 1. Nance Aleson 2. Judy Chang 3. Joan Templeton- Morris 4. Charles Ware 5. Erik Weigand A copy of the applications are attached hereto as Attachment A. Appointment Process Pursuant to City Council Policy A -2, appointments to the Commission will take place in the following manner: A. The City Council will vote on all appointments simultaneously. The voting will be done by paper ballot and the City Clerk will tabulate and announce the results, including the vote tally. B. Each member of the City Council will cast two votes on the paper ballot. In order to be appointed, an applicant must receive at least four votes. Since the terms expire at different times, the person receiving the most votes will serve the term ending June 30, 2017. If the top two vote recipients receive the same amount of votes, the City Council will vote again, casting only one vote between the two applicants to determine who will serve the June 30, 2017 unexpired term.
