A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH ESTABLISHING UNDERGROUND
UTILITY DISTRICT NO. 3 AND ORDERING THE
REMOVAL OF POLES, OVERHEAD WIRES AND ASSOC-
IATED OVERHEAD STRUCTURES AND THE UNDERGROUND
• INSTALLATION OF WIRES AND FACILITIES FOR
SUPPLYING ELECTRIC, COMMUNICATION, OR SIMILAR
OR ASSOCIATED SERVICE WITHIN THAT AREA OF THE
CITY LOCATED WITHIN SAID DISTRICT
WHEREAS, Chapter 15.32, entitled "Underground
Utilities ", of the Newport Beach Municipal Code, authorizes
the City Council to call public hearings to ascertain whether
the public health, safety or welfare require the removal of
poles, overhead wires and associated overhead structures
within designated areas of the City, and underground installa-
tion of wires and facilities for supplying electric, communica-
tion, or similar services; and
WHEREAS, on the 12th day of November, 1973, the City
Council took action to set a public hearing on the 10th day
of December, 1973, at 7:30 p.m., for the purpose of determin-
ing whether an underground utility district should be established
within that certain territory referred to as Underground Utility
District No. 3, which is hereinafter described; and
WHEREAS, notices have been sent to all property owners
within the territory proposed to be included within said under-
ground utility district, in the manner prescribed by said
Chapter 15.32 of the Newport Beach Municipal Code; and
WHEREAS, after consideration of all protests to the
formation of said Underground Utility District No. 3 the City
Council has determined that the public health, safety and
welfare require the formation of said District;
NOW, THEREFORE, the City Council hereby FINDS,
is DETERMINES AND ORDERS:
Section 1: The public necessity, health, safety
and welfare require the removal of poles, overhead wires and
associated overhead structures used to supply electric and
telephone service and their installation underground within
the following described area of the City of Newport Beach:
Parcel A
• A strip of land 300.00 feet in width, in the City of
Newport Beach, County of Orange, State of California,
the center line of said 300.00 feet wide strip of land
being described as follows:
Beginning at the intersection. of the center line of the
Pacific Coast Highway (100 feet in width), shown as
State Highway 101 -A (ORA 60 -B) and the northeasterly
prolongation of the westerly line of Lot A as shown on
a map of Tract 5361 recorded in Book 190, Page 48 of
Miscellaneous Maps, Records of said County; thence North
870 18' 31" East 190.00 feet along said center line of
the Pacific Coast Highway to the TRUE POINT OF BEGINNING;
thence easterly along said center line of the Pacific
Coast Highway through all of its various curves and
courses to the southerly prolongation of the easterly
line of Parcel 1, per map recorded in Book 12, Page 21
of Parcel Maps of said County; the westerly end of
Parcel A shall be a line radial to said center line,
and the easterly end of Parcel A shall be a line at
right angles to said center line.
Parcel B
Beginning at the intersection of the easterly line of
Jamboree Road as per map of Tract 5130 recorded in Book
190, Page 44 of Miscellaneous Maps, Records of said
County, with a line that is parallel with and distant
southerly 150.00 feet (measured at right angles) from
said center line of the PacificCoast Highway; thence
southerly, southeasterly, and easterly along said easterly
line of Jamboree Road and following the same through
all of its various curves and courses to the most southerly
corner of Lot 10, said Tract 5130; thence southeasterly
in a direct line to the northeasterly corner of Lot 1,
Tract 3232 as per map recorded in Book 99, Page 49 of
Miscellaneous Maps, Records of said Orange County;
thence southerly along the easterly line of said last
mentioned Lot 1 to the southeasterly corner thereof;
thence westerly along the southerly line of said last
mentioned Lot 1 to a line that is parallel with and
easterly 150.00 feet (measured at right angles) from
the center line of Marine Avenue (60 feet in width)
as shown on said map of Tract 3232; thence southerly
along said last mentioned parallel line to the southerly
line of Lot 2, said Tract 3232; thence westerly along
said southerly line of said Lot 2 to the easterly line
of said Marine Avenue; thence westerly in a direct line
to the southeasterly corner of Lot 3, Tract 8073, map
recorded in Book 327, Page 9 of Miscellaneous Maps,
Records of said County; thence westerly along the south-
erly line of said Lot 3 to the southwesterly corner
thereof; thence northerly and northwesterly along the
westerly line of said Lot 3, and following the same
through all of its various curves and courses to the
most northwesterly corner of said Lot 3; thence north-
westerly in a direct line to a point in the southerly
line of Parcel 4 per map recorded in Book 11, Page 7
of Parcel Maps of said County, said last mentioned point
being located easterly 634.60 feet along said last

mentioned southerly line from the southwesterly corner
of said Parcel 4: thence North 4° 15' 25" East 224.83
feet along the center line of a public utility easement
shown on said last described map; thence northerly in
a direct line to a point in the northerly line of said
Parcel 4, said last mentioned point being North 760 14'
18" West 93.62 feet from the northeasterly corner of
said Parcel 4; thence northerly in a direct line to a
point in a line that is parallel with and distant
southerly 150.00 feet (measured at right angles) from
said center line of the Pacific Coast Highway, said
last mentioned point being distant westerly 150.00 feet
measured along said last mentioned parallel line from
said center line of Jamboree Road as it is shown on said
map of Tract 5130; thence easterly along said last
mentioned parallel line to the point of beginning.
The City Council further finds that:
(1) The streets on which the work is to be performed
are extensively used by the general public and carry a heavy
volume of pedestrian or vehicular traffic; and
(2) The streets adjoin or pass through a public recreation
area and an area of unusual scenic interest to the general
public.
Section 2: The above described area is hereby
declared to be an underground utility district, to be known
as Underground Utility District No. 3, and the affected utility
companies and property owners are ordered to cause the required
removal and underground installation work to be done.
Section 3: The date by which the required removal
and underground installation work is to be accomplished and
by which the affected property owners must be ready to
receive underground service is July 15, 1974
Section 4: The City Clerk is directed to notify
all affected utility companies and all persons owning property
within said District of the adoption of this resolution within
ten (10) days after its effective date, in accordance with
Section 15.32.080 of the Newport Beach Municipal Code.
