RESOLUTION NO. 8153
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH AUTHORIZING THE
ASSISTANT TO THE CITY MANAGER - PERSONNEL
AND EMPLOYEE RELATIONS TO MAKE DETERMINA-
TIONS REGARDING THE DISABILITY RETIREMENT
OF LOCAL SAFETY MEMBER EMPLOYEES OF THE
CITY
WHEREAS, the City of Newport Beach is a contracting
agency of the Public Employees Retirement System; and
WHEREAS, the Public Employees Retirement Law re-
quires that a contracting agency determine whether a local
safety member employee of such agency is disabled for purposes
of the Public Employees Retirement Law and whether such dis-
ability is "industrial" within the meaning of such law; and
WHEREAS, the City Council has determined upon legal
advice that it may delegate authority to make such determina-
tions to the incumbent in the position of Assistant to the
City Manager - Personnel and Employee Relations;
NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of Newport Beach does hereby delegate to the
incumbent in the office of Assistant to the City Manager -
Personnel and Employee Relations the authority to make deter-
minations of disability under Section 21023.6 of the California
Government Code, on behalf of the City and to determine if
such disability is industrial and to certify such determina-
tions and all other necessary information to the Public
Employees Retirement System.
BE IT FURTHER RESOLVED that such incumbent is author-
ized to make applications on behalf of the City for disability
retirement of local safety member employees and to initiate
requests for reinstatement of such employees who are retired
for disability.

BE IT ALSO FURTHER RESOLVED that the City Clerk
is authorized and directed to transmit a certified copy of
this resolution to Public Employees Retirement System, P. O.
Box 1953 (1416 Ninth Street), Sacramento, California 95809:
