A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH REQUESTING THE
COUNTY TO CANCEL THE AHFP PROJECT
ADMINISTRATION AGREEMENT FOR THE CON-
STRUCTION OF UNIVERSITY DRIVE FROM
JAMBOREE ROAD TO MACARTHUR BOULEVARD
WHEREAS, on October 9, 1973, the City of Newport
Beach entered into an agreement with the State Department of
Transportation for the design and construction of University
Drive from Jamboree Road to MacArthur Boulevard; and
WHEREAS, a portion of the cost of the project was
to be contributed by the County of Orange by the terms of the
Project Administration Agreement for AHFP Project No. 631; and
WHEREAS, it has been determined that the project
must be postponed indefinitely, and it would be in the best
interests of the City and the County of Orange to cancel the
AHFP Agreement in order that the funds being held by the
County may be reallocated; and
WHEREAS, under the terms of the agreement with State
the City may withdraw from the agreement and pay only the
amount of the design charges incurred to date, which charges
have been paid;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that the staff be directed to
notify the State that the City is withdrawing from the cooperative
agreement covering the above - described construction;
BE IT FURTHER RESOLVED that the City Clerk is directed
to forward a copy of this resolution to the Orange County
Board of Supervisors, requesting that the Project Administration
Agreement for AHFP Project No. 631, covering the above - described
construction, be cancelled.
ADOPTED this 25th day of February, 1974.
