RESOLUTION NO. 8254
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH SUPPORTING THE MANDATORY
SENTENCING INITIATIVE
WHEREAS, the lack of a standardized sentencing policy
for serious felonies has led to discrepancies in sentencing
between various judges, to the extent that the use of probation
has, in many instances, allowed the release of felons who have
repeated the same types of violent crimes which caused their
original convictions; and
WHEREAS, the intent of Senate Bill 237, co- authored
by 35 members of the California State Senate, was to impose
mandatory sentencing for certain types of violent crimes; and
WHEREAS, although Senate Bill 237 received almost
absolute support by the Senate, it was subsequently stalled by
a narrow margin in the Assembly Criminal Justice Committee; and
WHEREAS, the Mandatory Sentencing Initiative, sponsored
by the California Peace Officers' Association following the
defeat of Senate Bill 237, would accomplish the same provisions
as SB 237 and has the support of many of the various law enforce-
ment associations and groups through the state; m d
WHEREAS, the City Council of the City of Newport
Beach has determined that the provisions of the Mandatory
Sentencing Initiative would be beneficial and in the best interests
of its citizens;
NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of Newport Beach hereby expresses its support of the
Mandatory Sentencing Initiative as the method of establishing a
necessary standardized mandatory sentencing policy in California
for serious felonies.
