A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE CITY MANAGER
TO ENTER INTO AGREEMENTS FOR THE USE'OF EXCESS
TIME ON THE CITY'S COMPUTER
WHEREAS, the City of Newport Beach owns and maintains
its own computer; and
• WHEREAS, presently the City of Newport Beach does not
use its computer 24 hours a day, 7 days a week; and
WHEREAS, there is a considerable amount of excess time
in which other persons, municipal corporations and political sub-
divisions may use the City's computer which will not conflict with
the City's primary use of its computer; and
WHEREAS, permitting other persons, political sub-
divisions and municipal corporations to use the City's computer
will help offset and defray the capital expenditures of the City
of Newport Beach in purchasing, maintaining and operating its
computer; and
WHEREAS, it is in the public interest that the City of
Newport Beach use its computer to its fullest utility and permit
other persons, political subdivisions and municipal corporations
to use the computer at times when it is not being used by the City
of Newport Beach;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that the City Manager is authorized to
enter into agreements for the use of the City's computer with
persons, political subdivisions and municipal corporations, pro-
vided that said usage will be limited to such times that the City
is not using its computer and which times will not conflict with
the City's use of its computer, and, provided further that said
agreement be substantially in the form of the agreement attached
hereto and incorporated herein by this reference and marked
Exhibit A.
