RESOLUTION NO. 2& 49 3
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH CONFIRMING AND ADOPTING THE
• STATEMENT OF COSTS AND EXPENSES INCURRED IN
THE ABATEMENT OF THE PUBLIC NUISANCE AND SUB-
STANDARD CONDITION OF THE PROPERTY LOCATED
AT 309 LA JOLLA DRIVE IN THE CITY OF NEWPORT
BEACH
WHEREAS, the City Council of the City of Newport Beach
adopted Resolution No. 8397 on December 9, 1974 finding and declar-
ing that a public nuisance existed at 309 La Jolla Drive in the
City of Newport Beach by virtue of Section 15.28.060 of the Newport
Beach Municipal Code; and
WHEREAS, the property located at 309 La Jolla Drive,
Newport Beach, California, is legally described as follows:
Parcel 1
Lots 9 and 10 of Tract No. 444, in the City of
Newport Beach, County of Orange, State of
California, as per map recorded in Book 19 page
29 of Miscellaneous Maps, in the office of the
County Recorder of said County.
Except from said Lots 9 and 10 the northwesterly
85.00 feet.
Said land is included within the area shown as
Parcel 2 of a parcel map filed in Book 42 page
40 of Parcel Maps, in the office of said County
Recorder.

The northeasterly 5.00 feet of the 10.00 feet wide
alley between Lots 10 and 30 of Tract No. 444, in
the City of Newport Beach, County of Orange, State
of California, as per map recorded in Book 19 page
29 of Miscellaneous Maps, in the office of the
County Recorder of said County, lying southeasterly
of the northeasterly prolongation of the south-
easterly line of the alley between Lots 10 and 11
of said tract, as abandoned by Resolution No. 4792
of the City Council of Newport Beach, a certified
copy of which was recorded May 15, 1958 in Book
4287 page 38 of Official Records.
• Said land is a portion of the alley shown within
Parcel 1 of a parcel map filed in Book 42 page 40
of Parcel Maps, in the office of the County Recorder
of said County; and
WHEREAS, Resolution No. 8397 of the City Council of the

City of Newport Beach was recorded in the Official Records of
Orange County, California, on January 13, 1975 in Book 11321, Page
1569, and said Resolution was further posted on the premises at
309 La Jolla Drive, in the.City of Newport Beach, California as
required by Section 15.28.060 of the Newport Beach Municipal Code; and
WHEREAS, the owner of said premises elected not to perform
the work to abate the public nuisance and substandard condition and
elected to have the City Manager cause the necessary work and abate-
ment to occur; and
WHEREAS, the work has been performed and completed and the
City Manager has caused to be prepared an itemized account of the
expenses involved in the actual repair as well as incidental and over-
head expenses related thereto, and said statement has been submitted
by the City Manager to the City Council, and a public hearing has
been held thereon on May 27, 1975, and all protests have been heard
by the City Council;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of
the City of Newport Beach that the statement of costs and expenses
incurred by the City, a copy of which is on file in the office of the
City Clerk of the City of Newport Beach, is hereby confirmed and
adopted in the amount of $2,820.96.
BE IT FURTHER RESOLVED that if said statement is not paid
within fifteen (15) days after the adoption and passage of this
Resolution, it shall constitute a lien on real property located at
309 La Jolla, Newport Beach, California, as described above, and
shall constitute a lien on the real property and shall be collected
as a special assessment against such real property, and shall be
filed with the Orange County Auditor, the Orange County Assessor, and
the Orange County Tax Collector unless the expense statement is paid
within fifteen (15) days after the adoption and passage of this
Resolution.
BE IT FURTHER RESOLVED, that, in event such statement is
paid within fifteen (15) days from the date hereof, this Resolution

shall be void.
BE IT FURTHER RESOLVED, that the City Clerk shall cause to
be mailed a copy of this Resolution and the itemized statement to the
• owner of said property, as shown on the last equalized tax roll, or
such later records as are available to the City Clerk, by first class
mail, postage fully pre -paid, and cause a copy of this Resolution
and said statement to be posted on the real property involved.
