HomeMy WebLinkAbout8971 - Use Permit 1805 - Apadana RestaurantRESOLUTION NO. 8971 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH APPROVING A JOINT USE PARKING AGREEMENT FOR THE USE OF • APADANA'S RESTAURANT AT 600D NEWPORT CENTER DRIVE IN CONJUNCTION WITH USE PERMIT NO. 1805 WHEREAS, the Planning Commission of the City of Newport Beach approved Use Permit No. 1805 on November 18, 1976, approving Apadana's Restaurant at 600D Newport Center Drive; and WHEREAS, the Planning Commission required parking at the rate of one space for each thirty square foot of public area; and WHEREAS, Section 20.30.035D of the Newport Beach Municipal Code provides that the Planning Commission may recommend and the City Council may approve a waiver of or reduction in off - street parking required when the building site is subject to two or more uses and the maximum parking require- ments for such uses do not occur similtaneously; and WHEREAS, Apadana's Restaurant will be primarily a night time use and the other uses of the parking structure to be used by Apadana's Restaurant will occur during the day time and the overlapping lunch time parking is deemed to be of minimal impact and parking appears to be adequate; and WHEREAS, the Planning Commission has recommended a joint use parking arrangement for the operation of Apadana's Restaurant. NOW, THEREFORE, BE IT RESOLVED by the City Council of • the City of Newport Beach that a joint use parking arrangement for Apadana's Restaurant located at 600D Newport Center Drive be approved pursuant to Section 20.30.035D of the Newport Beach • 0 Municipal Code, which permits fifty percent (50 %) of the required parking to be shared with parking for the office uses prior to 5:00 P.M.
