A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH DECLARING ITS INTENTION TO
ORDER THE VACATION AND ABANDONMENT OF AN
• EXISTING 10 -FOOT WIDE PUBLIC UTILITY EASEMENT
OVER LOT 49, TRACT NO. 9261, AND SETTING A
PUBLIC HEARING FOR MARCH 14, 1977
The City Council of the City of Newport Beach under
the provisions of the "Public Service Easements Vacation Law"
and amendments thereto, Section 50430 et sec, of the California
Government Code, does hereby resolve and declare as follows:
SECTION 1. The public interest and convenience require,
and it is the intention of the City Council of the City of
Newport Beach to order the vacation and abandonment of an
existing 10 -foot wide public utility easement over Lot 49,
Tract No. 9261 (Yacht Resolute in "Seaview Area "), which is more
particularly described as follows:
"A 10 -foot wide public utility easement along
the northeasterly side of Lot 49, Tract 9261
as shown on a map filed in Book 380, pages 32
to 35 inclusive, Miscellaneous Maps, Records
of Orange County, California."
Said segment of the existing 10 -foot wide public
utility easement to be vacated and abandoned is shown on a certain
map entitled Exhibit "A" prepared by the City of Newport Beach
Public Works Department dated February 1, 1977, a copy of which
is attached hereto, marked Exhibit "A" and incorporated herein by
this reference.
SECTION 2. The proceedings for the vacation and aban-
donment of said existing 10 -foot wide public utility easement
are taken pursuant to, and the City Council of the City of
Newport Beach elects to proceed under the provisions of, the
• "Public Service Easement Vacation Law" and all amendments thereto,
being Sections 50430 to 50445, inclusive, of the California
Government Code.

SECTION 3. The Public Works Director of the City of
Newport Beach shall cause to be conspicuously posted along the
line of said easement proposed to be vacated and abandoned, not
• more than three hundred (300) feet apart, and not less than
three (3) in all, notices of the vacation and abandonment of
said easement. The notices shall state the passage of this
Resolution of Intention and the time and place of the hearing
before the City Council of all persons interested in or objecting
to the proposed vacation and abandonment. Said notice shall be
posted at least ten (10) days before the date of said hearing.
SECTION 4. Notice is hereby given that the City Council
of the City of Newport Beach does hereby fix Monday, the 14th day
of March, 1977, at the hour of 7:30 P.M. on said day in the
Council Chambers located in the City Hall of the City of Newport
Beach at 3300 Newport Boulevard, Newport Beach, California, as the
time and place for hearing all persons interested in or objecting
to the proposed vacation and abandonment of said existing 10 -foot
wide public utility easement.
SECTION 5. A notice of the hearing hereinabove set,
giving the date, time and place of said hearing, shall be
published by the City Clerk in the official newspaper of the City
once each week for at least two successive weeks prior to said
hearing.
