RESOLUTION NO. 9030
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH ADOPTING THE DIRECTOR OF THE
DEPARTMENT OF INDUSTRIAL RELATION'S DETERMINA-
TION OF THE PREVAILING WAGE RATES FOR ORANGE
COUNTY
WHEREAS, Section 1771 of the Labor Code of the
State of California requires that not less than the general
prevailing rate of per diem wages shall be paid to all workmen
employed on public works contracts; and
WHEREAS, Section 1773 of the Labor Code of the State
of California requires that the body awarding the public works
contract shall obtain the general prevailing wage rates from
the Director of the Department of Industrial Relations; and
WHEREAS, Section 1773.2 of the Labor Code provides
that in lieu of specifying the general prevailing wage rates
in the call for bids, in the bid specifications, and in the
contract itself, that the awarding body may refer to a copy
of the prevailing rate of per diem wages on file at its
principal office if the awarding body publishes the determination
of the prevailing wage rates at least one time in a newspaper
of general circulation during each year and posts a copy thereof
at each job site.
NOW, THEREFORE, the City Council of the City of
Newport Beach does hereby resolve as follows:
Section 1. That the general prevailing rates of
per diem wages for each craft, classification or type of workman
needed to execute public works contracts and the general prevailing
rate for legal holiday and overtime work for each craft,
classification, or type of workman are in accordance with the

Determination of the Director of the Department of Industrial
Relations for Orange County marked Exhibit "A" and made a
part herein by this reference, which is on file in the office
of the Director of Public Works of the City of Newport Beach
and a copy also on file in the City Clerk's Office.
Section 2. That this Resolution shall be published
at least one time each year in a newspaper of general circula-
tion and posted on the job site of each public works job
site prior to the commencement of any work.
Section 3. Resolution No. 8950 and any other
resolutions, motions or portions thereof in conflict herewith,
are hereby rescinded.
