A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH APPROVING THE DESTRUCTION
OF JUVENILE ARREST RECORDS ORDERED SEALED BY
• THE COURT
WHEREAS, Section 1203.45 of the California Penal
Code authorizes certain juvenile arrest records to be sealed
by the court; and
WHEREAS, Section 34090 of the California Government
Code provides that the head of a city department, with the
approval of the legislative body by resolution, and the written
consent of the City Attorney, may destroy certain records
without making a copy thereof; and
WHEREAS, the Chief of Police has requested approval
by the City Council for the destruction of misdemeanor juvenile
arrest records ordered sealed by the court which are more than
two years old; and
WHEREAS, the City Council finds and determines that
said records are no longer required to be kept.
NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of Newport Beach hereby approves of the destruction
of juvenile arrest records in the custody of the Chief of
Police ordered sealed pursuant to Section 1203.45 of the California
Penal Code; said records to be destroyed on the 21st birthday
of the juvenile arrestee.
ADOPTED this 11th day of April , 1977.
