RESOLUTION NO. 9192
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH ACCEPTING THE NEGATIVE
DECLARATION AND APPROVING AMENDMENTS TO THE
LAND USE, RESIDENTIAL GROWTH, RECREATION AND
OPEN SPACE ELEMENTS OF THE NEWPORT BEACH
GENERAL PLAN (AMENDMENT NO. 77 -2)
WHEREAS, Section 707 of the Charter of the City
of Newport Beach provides that the City Council, upon recommenda-
tion by the Planning Commission, may amend the General Plan,
or any part thereof; and
WHEREAS, the General Plan of the City of Newport
Beach contains the Land Use, Residential Growth, and Recreation
and Open Space Elements which will serve as a guide for the
future planning and development of the City; and
WHEREAS, the Planning Commission has held a public
hearing at which time it considered certain amendments to the
Land Use, Residential Growth and Recreation and Open Space
Elements and adopted Resolution No. 993, recommending to the
City Council certain changes in said elements; and
WHEREAS, the City Council finds and determines that
the proposed amendment will not have a significant effect on
the environment and desires to accept a Negative Declaration
prepared for said General Plan amendment.
NOW, THEREFORE, BE IT RESOLVED that the City Council
hereby accepts the Negative Declaration on General Plan Amendment
No. 77 -2.
BE IT FURTHER RESOLVED that the following described
amendment to the General Plan, and the various Elements thereof
be adopted, as follows:
77 -2 -D. An amendment to the Land Use Plan,
Residential Growth and Open Space Plans to change the designa-

tion of the MWD Reservoir Site and adjacent property in the
Spyglass Hill area, deleting the "governmental, educational
and institutional facilities" designation and rearranging the
"recreational and environmental open space" and "residential"
designations. Further, the following wording be added to the
Land Use and Residential Growth Elements as follows:
(a) To Page 24 of the Land Use Element:
"Development of the MWD Reservoir Site on parcels
adjacent to San Miguel Drive and Spyglass Hill Road
shall be limited to a combination of neighborhood park,
open space and residential use. It is anticipated that
approximately nine acres of this site will be used for
park purposes and approximately 11.5 acres will be
devoted to low density residential use as described in
the Residential Growth Element. In connection with the
preparation of specific development plans, an environ-
mental impact report shall be prepared which addresses,
in part, the issues of on -site and off -site parking in
relation to the park site, and the impact of residential
development on traffic, public service and support
systems."
(b) To Page 20 of the Residential Growth Element:
"Residential development of the MWD Reservoir Site
shall be limited to an area totalling approximately 11.5
acres and shall be limited to a maximum of four dwelling
units per buildable acre."
77 -2 -E An amendment to the Recreation and Open
Space Element to:
(a) Reflect the increase and park dedication
requirements from two to five acres per 1,000 population
(resulting from the City Council's adoption of the
"Atherton Initiative Ordinance" on April 25, 1977);
(b) Update the number and acreage of existing
public parks; and
(c) Delete reference to excise tax dollar amounts.
The specific changes are as follows:
(1) The first sentence of paragraph 1, under
definitions on page 4 of the Recreation and Open Space
Element should be amended to read as follows:
"The City has an adopted standard of five
acres of neighborhood parks per thousand
residents..."
(2) The footnote on the bottom of Figure 1 on
page 10 of the Recreation and Open Space Element should
be amended to read:
"The adopted park standard for the City
of Newport Beach is five acres per thousand
residents."

(3) Page 12 of the Recreation and Open
Space Element should be amended to read as follows:
"Evaluation of Existing Facilities.
There are 21 existing neighborhood
parks and 4 privately owned parks in the City
with a total area of 95 acres, resulting in
1.5 acres of public park area per thousand resi-
dents (based on the January, 1977 population of
64,200 persons). Although this is short of the
five acres per thousand standard, most of the
City's residential areas are well served with
conveniently located parks."
(4) Figure 2 on page 13 of the Recreation and
Open Space Element should be amended by including
recently completed facilities.
(5) Page 17 of the Recreation and Open Space
Element should be amended to read as follows:
"These parks will be of sufficient size
to result in approximately five acres per
thousand residents."
(6) Page 68, the second, third and fourth
sentences of the Recreation and Open Space Element
should be amended as follows:
"These funds result from a development
tax which is imposed on all residential,
commercial, and industrial developments within
the City and is used exclusively for the development
of fire stations, libraries and parks."
