RESOLUTION NO. 9199
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH DECLARING ITS INTENTION TO
• ORDER THE VACATION AND ABANDONMENT OF PORTIONS
OF 23RD STREET AND IRVINE AVENUE, AND SETTING
_ A PUBLIC HEARING FOR NOVEMBER 14, 1977
The City Council of the City of Newport Beach under
the provisions of the "Public Service Easements Vacation Law"
and amendments thereto, Section 50430 et seq. of the California
Government Code, does hereby resolve and declare as follows:
SECTION 1. The public interest and convenience require,
and it is the intention of the City Council of the City of
Newport Beach to order the vacation and abandonment of portions
of 23rd STreet and Irvine Avenue, which is more particularly
described as follows:
"A parcel of land being a portion of Lots
308, 318 and 328 of Newport Heights, as shown
on a map thereof recorded in Book 4, Page 83
of Miscellaneous Maps, Records of Orange County,
said parcel being a strip of land 60.00 feet in
width, lying 30.00 feet on each side of the
following described centerline:
Beginning at the point of intersection
of the centerlines of 22nd Street and Irvine
Avenue, as both 22nd Street and Irvine Avenue
are shown on said map of Newport Heights; thence,
North 40 100'00" East along said centerline of
Irvine Avenue, 582.40 feet to a point on a curve
concave Westerly and having a radius of 540.00
feet and a central angle of 53 139'04 ", said point
also being the TRUE POINT OF BEGINNING, thence
continuing along said centerline North 40 100'00"
East a distance of 739.47 feet to a point of
intersection with the centerline of the right-
of -way of 23rd Street, as shown on said map of
Newport Heights, thence North 50 °00100" West a
distance of 452.35 feet along the centerline
of said 23rd Street and terminating in the
Easterly right -of -way boundary for Irvine Avenue
as said right -of -way was dedicated per grant of
easement recorded in Book 8603, Page 885 of
Official Records of Orange County.
The sideline of the aforementioned strip of
land being prolonged or shortened so as to
terminate in Easterly right -of -way line of Irvine
Avenue as said Irvine Avenue right -of -way was
granted per the aforementioned easement recorded
in Book 8603, Page 885 of Official Records of
Orange County."
Said portion of Irvine Avenue to be vacated and
abandoned is shown on a certain map entitled Exhibit "A" prepared
• by the City of Newport Beach Public Works Department dated
September 10, 1976, a copy of which is attached hereto, marked
Exhibit "A" and incorporated herein by this reference.
SECTION 2. The proceedings for the vacation and
abandonment of said portion of Irvine Avenue are taken pursuant
to, and the City Council of the City of Newport Beach elects
to proceed under the provisions of, the "Public Service Easement
Vacation Law" and all amendments thereto, being Sections 50430
to 50445, inclusive, of the California Government Code.
SECTION 3. The Public Works Director of the City of
Newport Beach shall cause to be conspicuously posted along the
portion of said property proposed to be vacated and abandoned,
not more than three hundred (300) feet apart, and not less than
three (3) in all, notices of the vacation and abandonment of
said property. The notices shall state the passage of this
Resolution of Intention and the time and place of the hearing
before the City Council of all persons interested in or objecting
to the proposed vacation and abandonment. Said notice shall be
posted at least ten (10) days before the date of said hearing.
SECTION 4. Notice is hereby given that the City Council
of the City of Newport Beach does hereby fix Monday, the 14th
day of November, 1977, at the hour of 7:30 P.M. on said day in
the Council Chambers located in the City Hall of the City of
Newport Beach at 3300 Newport Boulevard, Newport Beach, California,
• as the time and place for hearing all persons interested in or
objecting to the proposed vacation and abandonment of said portion
of 23rd Street and Irvine Avenue right -of -way.
SECTION 5. A notice of the hearing hereinabove set,
giving the date, time and place of said hearing, shall be

published by the City Clerk in the official newspaper of the
City once each week for at least two (2) successive weeks
9 prior to said hearing.
ADOPTED this 11th day of October , 1977.
