A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH APPROVING AMENDMENTS TO THE
PLANNED COMMUNITY DEVELOPMENT PLAN FOR
CORPORATE PLAZA TO PERMIT GENERAL CHANGES IN
THE LAND USE MAP AND TEXT (Amendment No. 506)
WHEREAS, Section 20.51.045 of the Newport Beach
Municipal Code provides the City Council may amend the
Planned Community Development Plan after it has held at
least one (1) public hearing thereon and has received a
report from the Planning Commission; and
WHEREAS, the Planning Commission conducted a
public hearing on April 6, 1978, on Amendment No. 506, and
in accordance with the provisions of law, adopted its
Resolution No. 1007 recommending certain changes to the Planned
Community Development Plan for Corporate Plaza to permit general
changes in the Land Use Map and Text; and
WHEREAS, the Planning Commission recommended certain
changes to the Planned Community Development Plan for Corporate
Plaza which are generally set forth as follows:
I. Site Plan
The Site Plan has been amended to reflect a more
precise dimensioning of the twenty -six (26) building sites
and changes in setbacks from streets, driveways and parking
areas and separations between buildings. Adjustments to
the floor area permitted on individual sites have been made,
however, no changes have been made so far as the required
phasing or total square footage is concerned. The Planning
Commission did not recommend any changes in parking
requirements.
II. Section I. Statistical Analysis
An amendment to page 2 of the Planned Community
text to grant to the Community Development Director the
.ie ability to adjust the square footage of individual buildings
provided that the total square footage does not exceed
the total buildable area or the phased development of the
site.
III. Section IV. Business, Professional and Commercial
B. Permitted Uses
An amendment to provide restaurants shall be
subject to the securing of a use permit in each case, and
that no restaurants are permitted in the buildings at
Site Numbers 3, 4 and 5.
Drive -up tellers, as a permitted use, subject
to review of on -site parking circulation by the Traffic
Engineer and Director of Community Development.
D. Building Heights
Reference to the number of stories within each
structure has been deleted, however, the overall height
limitation of each structure has not increased.
G. Parking
The Planning Commission did not recommend
any changes in parking requirements pertaining to credit
for stacking area and drive -up tellers, compact car spaces,
or a reduction of the total spaces required; and
WHEREAS, the City Council finds and determines that
the amendments to the Planned Community Development Plan for
Corporate Plaza set forth above are desirable and necessary,
• except as noted;
NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of Newport Beach hereby amends the Planned Community

Development Plan for Corporate Plaza, as follows:
A. The amendment to the Site Plan;
B. Page 2, Statistical Analysis, is amended by
adding paragraph 5 thereto to read as follows:
"5. The square footage of individual
buildings shown on the Site Plan are
tentative and subject to adjustment as
long as the limitations on total and
phased development are not violated.
Any adjustment in the square footages
for each building as shown on the Site
Plan will be reviewed and approved by the
Director of Community Development."
C. Page 5, paragraph B, Permitted Uses, subparagraph
3, is amended as follows:
"3. Restaurants, including outdoor, drive -
in or take -out restaurants, shall be subject
to the securing of a use permit in each case.
Facilities other than indoor dining establish-
ments or those that qualify as outdoor, drive -
in or take -out establishments shall be subject
to the City of Newport Beach regulations
covering drive -in and outdoor establishments.
"Restaurant uses shall not be permitted on
Building Site Numbers 3, 4 or 5."
D. Page 5, paragraph B, Permitted Uses, subparagraph
7, is amended as follows:
"7. Drive -up teller units, subject to the review
of the on -site parking and circulation plan by
the City Traffic Engineer and approved by the
Director of Community Development."
E. The requested changes to the parking requirements
are denied.
