RESOLUTION NO. 9476
• A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH ACCEPTING THE NEGATIVE
DECLARATION AND APPROVING AMENDMENTS TO THE
LAND USE AND RESIDENTIAL GROWTH ELEMENTS OF
THE NEWPORT BEACH GENERAL PLAN (AMENDMENT
NOS. 78 -3 -A and 78 -3 -C)
WHEREAS, Section 707 of the Charter of the City of
Newport Beach provides that the City Council, upon recommendation
by the Planning Commission, may amend the General Plan or any
part thereof; and
WHEREAS, the General Plan of the City of Newport Beach
contains the Land Use, Residential Growth, and Recreation and
Open Space Elements which will serve as a guide for the future
planning and development of the City; and
WHEREAS, the Planning Commission has held a public
hearing at which it considered amendments to the Land Use and
Residential Growth Elements and adopted Resolution No. 1022,
recommending to the City Council certain changes in said elements;
and
WHEREAS, the City Council finds and determines that
the proposed amendments will not have a significant effect on
the environment and desires to accept a Negative Declaration
prepared for said General Plan Amendment,
NOW, THEREFORE, BE IT RESOLVED that the City Council
hereby accepts the Negative Declaration on General Plan
Amendment Nos. 78 -3 -A and 78 -3 -C and denies approval of
Amendment No. 78 -3 -B.
BE IT FURTHER RESOLVED that the following described
amendment to the General Plan be adopted as follows:
78 -3 -A: An amendment to the Land Use and
Residential Growth Elements to allow "Administrative,
Professional, and Financial Commercial" as an alternate
land use on a 4.5 acre parcel on University Drive
east of Irvine Avenue (Deane Property) in addition
to "Multiple- Family Residential."
• 78 -3 -C: An amendment to the Land Use Element
to allow "Retail /Service Commercial" and "Residential"
as alternate uses to the existing "Administrative,
Professional and Financial Commercial" designation
within the Old Newport Boulevard Specific Area Plan
District.
ADOPTED this 11th day of December 1978.
