A RESOLUTION OF THE CITY COUNCIL OF THE CITY
• OF NEWPORT BEACH CONCERNING CHARITABLE PAYROLL
DEDUCTIONS
WHEREAS, Section 1157.2 of the Government Code provides
that "With the approval of the governing body of a public agency
and under such regulations as it may prescribe, employees of the
public agency may authorize deductions to be made from their
salaries or wages either for the payment of contributions to bona
fide charitable organizations or for the payment of designated
sums to a nonprofit California corporation which is compelled by
its bylaws to make, and which does expend such sums solely by the
making of contributions to bona fide charitable organizations "; and
WHEREAS, Section 13923 of the Government Code provides
that charitable payroll deductions from the salaries or wages of
state officers and employees are available for charitable contribu-
tions made to the agency handling the principal combined fund
drive in any areas; and
WHEREAS, the City of Newport Beach desires to minimize
loss of productive work -time from public business by City employees
occasioned by charitable fund drives in City facilities; and
WHEREAS, the City Council of the City of Newport Beach
considers a single, combined fund drive on behalf of charitable
organizations to be more efficient, effective and equitable than
multiple fund drives and thus in the best interests of the City
and its employees; and
WHEREAS, the City Council of the City of Newport Beach
be an appropriate and desirable precendent for application with
Newport Beach; and
considers

charitable
payroll
deductions
for state officers and employees to
be an appropriate and desirable precendent for application with
Newport Beach; and
WHEREAS, the City Council of the City of Newport
Beach in determining which organization is best suited to
conduct the single, combined fund drive among Newport Beach
• City employees has considered the following criteria:
A. The number of charitable agencies in the City
of Newport Beach which rely on the drive for their support;
B. The number of dollars raised in the City of
Newport Beach during the last completed fund drive
C. The percentage of dollars dispersed to charitable
agencies as a result of the drive;
D. The organization using the American Institute of
Certified Public Accountants AICPA standards of accounting for
financial reporting;
NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of Newport Beach hereby approves and provides, subject
to such regulations as the City Manager may prescribe, that
charitable payroll deductions from the salaries or wages of
employees of the City of Newport Beach are available for charitable
contributions to the principal combined fund drive of United Way
of Orange County (north and south).
