RESOLUTION NO. 9702
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH SELECTING HARBOR
TOWING AND G & W TOWING AS THE OFFICIAL
POLICE TOW TRUCK SERVICE OPERATORS, ISSUING
A CERTIFICATE OF'PUBLIC CONVENIENCE AND
NECESSITY THEREFOR AND AUTHORIZING THE
EXECUTION OF AN AGREE14ENT BETWEEN THE CITY
OF NEWPORT BEACH AND HARBOR TOWING AND G & W
TOWING IN CONNECTION WITH THE OFFICIAL POLICE
TOW SERVICES
WHEREAS, Section 5.15.070 of the Newport Beach
Municipal Code requires that the official police tow truck
service operator shall obtain a certificate of public convenience
and necessity therefore; and
WHEREAS, Section 5.15.030 of the Newport Beach
Municipal Code provides that there shall be two official police
tow truck services selected and designated to provide service
at the'request of the Newport Beach Police Department; and
WHEREAS, pursuant to Section 5.15.050 of the Newport
Beach Municipal Code a public hearing has been held by the City
Council regarding the selection of two official police tow
truck service operators and the issuance of a certificate of
public convenience and necessity therefore; and
WHEREAS, Harbor Towing and G & W Towing have submitted
applications' to the City of Newport Beach to be designated as
the official police tow truck service; and
WHEREAS, there has been presented to the City Council
of the City of Newport Beach certain agreements between the City
of Newport Beach and Harbor Towing and G & W Towing in regards
to official police tow services; and
WHEREAS, the City Council has considered the terms
and conditions of the applications for the official police tow
truck service operations.and the agreements and found them to
be fair and equitable, and in the best interest of the City;

NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that there is hereby issued to
Harbor Towing and G & W Towing a certificate of public convenience
and necessity to operate the official police tow truck service
within the City of Newport Beach, pursuant to Section 5.15.070
of the Newport Beach Municipal Code.
BE IT FURTHER RESOLVED that Harbor Towing and G & W
Towing are designated as the official police tow services
pursuant to Section 5.15.030 of the Newport Beach Municipal Code.
BE IT FURTHER RESOLVED that the agreement for the tow
truck services above - described are approved, and the Mayor and
City Clerk are hereby authorized and directed to execute the same
on behalf of the City of Newport Beach.
