• A RESOLUTION FO THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH ESTABLISHING A LOCAL 208
PLANNING ADVISORY GROUP AND SETTING FORTH THE
DUTIES AND RESPONSIBILITIES THEREOF
WHEREAS, the Cities of Newport Beach and Irvine have
entered into a Cooperative Agreement with the Southern California
Association of Governments (SCAG) to development a Comprehensive
Sedimentation Control Plan under federal 208 funding; and
WHEREAS, the formation of a public advisory group by 208
planning agencies is required under Title 40, Part 25, of the
United States Code of Federal Regulations; and
WHEREAS, the City Council desires that public input be
an integral part of the 208 Plan preparation,
NOW, THEREFORE, BE IT RESOLVED that a Local 208 Planning
Advisory Group be established in accordance with federal regula-
tions. The Local 208 Planning Advisory Group shall consist of
sixteen (16) members to be selected jointly by the City Councils
of the Cities of Newport Beach and Irvine. All members shall
possess full voting rights. The Group shall include four (4)
members from each of the following groups:
1. Private Citizens - No person may be included in this
group who is likely to incur a financial gain or loss greater
than that
of
an average homeowner,
taxpayer
or
consumer
as a
result of
any
action likely to be
taken by
the
cities as
a
result of their 208 planning.
2. Public Interest Groups - A public interest group is
defined as an organization which reflects a general civic,
social, recreational, environmental or public health
perspective in the area, and which does not directly reflect
the economic interests of its membership.
3. Public Officials.
4. Citizens or representatives of organizations with
substantial economic interests in the plan or project.
The duties and responsibilities of the Advisory Group
shall be as follows:
1. Monitor the progress of the 208 Plan.
2. Examine alternative sedimentation control strategies
proposed by the Cities' engineering consultant.
3. Make written recommendations to the Newport Beach
and Irvine City Councils regarding committee consensus as to
type and location of control measures.
BE IT FURTHER RESOLVED by the City Council of the City
of Newport Beach that:
1. The officers of said Advisory Group shall be elected
by the Advisory Group and be comprised of a chairman, vice-
chairman and a secretary.
2. A quorum shall consist of one -third of any currently
serving membership, but not less than six (6) persons.

3. Advisory Group meetings shall be open to the public
• and opportunity for public comment shall be provided.

4. Advisory Group meetings shall be announced well in
advance.
5. The minutes of each meeting shall be recorded by the
secretary and transmitted to the City Councils of the Cities
of Newport Beach and Irvine.
6. All minutes and recommendations to the respective
City Councils shall be available to the public.
7. Any letter written by a member of the Advisory
Group, representing the Advisory Group or stating any recom-
mendation or action of the Advisory Group, must be approved
by the chairman or vice - chairman before transmittal to any
third party, and a copy delivered to the secretary for
filing.
8. If an appointee is absent from three (3) consecutive
meetings while not absent from the County, this fact shall be
reported to the City Councils of the Cities of Newport Beach
and Irvine.
9. This Advisory Group shall terminate and cease to
exist on November 1, 1982, or upon adoption of a Comprehen-

sive Stormflow Sedimentation Control Plan by the Cities of
Newport Beach and Irvine, whichever is earlier.
