RESOLUTION NO. 9964
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH REQUESTING THE BOARD OF
SUPERVISORS OF THE COUNTY OF ORANGE TO CON-
SOLIDATE A SPECIAL MUNICIPAL ELECTION OF THE
CITY OF NEWPORT BEACH WITH THE STATEWIDE
GENERAL ELECTION PURSUANT TQ SECTION 23302 OF
THE CALIFORNIA ELECTIONS CODE
WHEREAS, a special municipal election is to be held in
the City of Newport Beach on November 3, 1981, relating to an
increase in the Transient Occupancy Tax (Bed Tax) and an increase
in like amount the appropriations limit; and
WHEREAS, it is desirable that said special municipal
election be consolidated with the statewide election to be held
on the same date, and that within the City of Newport Beach the
precincts, polling places and election officers of the two elec-
tions be the same and that the special municipal election be held
in all respects as if there were only one election,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NEWPORT
DOES HEREBY RESOLVE,
AND ORDER AS FOLLOWS:
1. That pursuant to the requirements of Section 23302
of the Elections Code of the State of California, the Board of
Supervisors of the County of Orange be and hereby is requrested
that said Board consent to and agree to the consolidation of a
special municipal election with the statewide election to be held
on November 3, 1981, for the purpose of submitting to the
qualified voters of said City a City measure relating to an
increase in the Transient Occupancy Tax (Bed Tax) and an increase
in a like amount of the appropriations limit.
2. That on the ballots to be used for said special
municipal election, in addition to any other matters required by
law, there shall be printed substantially the following:

Shall Section 3.16.030 of the Newport
Beach Municipal Code be amended to
increase the Transient Occupancy Tax
rate from six percent (6 %) of the rent
charged by each hotel operator to
/G -117- percent (__a %) of the rent
charged by the operator to be paid by
the transient in any hotel; and shall
the limitations imposed by Article XIII -B
of the State Constitution be increased
in the amount of revenue generated by
the increase in said tax rate and for a
period of time not to exceed four years
from the date of approval hereof?

3. Said Board of Supervisors is hereby requested to
issue instructions to the Registrar of Voters to take any and all
steps necessary for the holding of said consoldiated election.
4. The City of Newport Beach recognizes that addi-
tional costs will be incurred by the County by reason of this
consolidation and agrees to reimburse the County for any such
costs.
5. That the City Clerk of the City of Newport Beach be
and hereby is directed to file a certified copy of this resolu-
tion with the Board of Supervisors and the Registrar of Voters of
the County of Orange.
