• A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH DECLARING ITS INTENTION TO
VACATE A SEWER EASEMENT (EASTERLY OF MACARTHUR
BLVD. BETWEEN BIRCH ST. AND CAMPUS DR.) IN
CONNECTION WITH RESUBDIVISION NO. 579 AND
ADOPTING A MAP SHOWING THE SEWER EASEMENT
PROPOSED TO BE VACATED AND SETTING A PUBLIC
HEARING THEREON (DWG. R/W 5449 -L)
WHEREAS, the City Council of the City of Newport Beach,
pursuant to the provisions of the Street Vacation Act and all
amendments thereto, being Sections E1300 to 8325 and 8340 to 8353,
inclusive, of the Streets and Highways Code of the State of
California, provides for vacation and abandonment of easements;
and
WHEREAS, the sewer easement located easterly of
MacArthur Blvd, between Birch St, and Campus Dr., appears to be
unnecessary for present or prospective public use, and it is the
intention of the City Council of -the City of Newport Beach to
vacate and abandon said easement; and
WHEREAS, the sewer easement to be vacated is shown on a
map which is attached hereto as Exhibit "A ", and the legal
description of the sewer easement is set forth on Exhibit "B"
attached hereto, which map and legal description are incorporated
herein by reference and made a part of this Resolution as though
fully set forth in full; and
WHEREAS, proceedings for the vacation of the above -
described sewer easement shall be undertaken by the City Council
of the City of Newport Beach, pursuant to the provisions of the
• Street Vacation Act of 1941 and all amendments thereto, being
Sections 8300 and 8325, and 8340 to 8353 inclusive, of the
Streets and Highway Code of the State of California;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that notice is hereby given that the
• City Council of the City of Newport Beach does hereby
fix September 28, 1981, at the hour of 7:30 p.m. of said day, in
the City Council Chambers of the City of Newport Beach, located
at 3300 Newport Boulevard, Newport Beach, California, as the time
and place for hearing all persons interested in or objecting to
the proposed vacation of said sewer easement, and the City
Council at said time and place will hear the evidence offered by
any person interested in the vacation of the sewer easement,
hereinbefore described.
BE IT FURTHER RESOLVED that this Resolution of
Intention shall be published at least once in the official
newspaper of the City, and said publication shall be made before
the date set for the hearing of all persons interested in or
objecting to the proposed vacation.
ADOPTED this 28th day of September, 1981.
