A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH ORDERING THE VACATION AND
ABANDONMENT OF A SEWER EASEMENT IN CONNECTION
WITH RESUBDIVISION NO. 579 AND DIRECTING THE
CITY CLERK TO HAVE SAME RECORDED BY THE ORANGE
COUNTY RECORDER
WHEREAS, the Public Works Director of the City of
Newport Beach has presented to the City Council of the City of
Newport Beach a certain map attached hereto as Exhibit "A" and
Drawing No. R/W 5449, attached hereto as Exhibit "B ", prepared by
the Public Works Department in connection with Resubdivision 579
for the abandonment of a sewer easement located easterly of
MacArthur Boulevard between Birch Street and Campus Drive and
more particularly described as:
Those portions of Parcels 1 and 2 as shown on
map filed in Book 120, Pages 44 and 45 of
Parcel Maps, in the Office of the Recorder of
the County of Orange, State of California,
described as follows:
That certain strip of land, 10.00 feet wide,
described in deed to the City of Newport Beach
recorded in Book 11563, Page 619 of Official
Records of said County and as shown on said
map; and
WHEREAS, the City Council of the City of Newport Beach
has approved and adopted said map and directed the City Clerk to
file same in the proceedings for the vacation and abandonment of
said sewer easement; and
WHEREAS, on October 26, 1981, the City Council held a
public hearing for the purpose of hearing all persons interested
in or objecting to the proposed vacation and abandonment of said
sewer easement; and
WHEREAS, the City Council finds and determines from all
of the evidence submitted that the subject sewer easement
described herein is unnecessary for present or prospective public
use,
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that the sewer easement described above
and located easterly of MacArthur Boulevard between Birch Street
• and Campus Drive, in connection with Resubdivision
No. 579, is hereby ordered vacated and abandoned.
BE IT FURTHER RESOLVED that the City Clerk is hereby
ordered to cause a certified copy of such Order, attested by the
Clerk under the seal of the City of Newport Beach, to be recorded
in the Office of the County Recorder of the County of Orange.
ADOPTED this 26th day of October, 1981.
