HomeMy WebLinkAbout11100 - City Attorney Michael MillerRESOLUTION NO. 11100 • A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH APPOINTING MICHAEL H. MILLER AS CITY ATTORNEY FOR THE: CITY OF NEWPORT BEACH, FIXING SALARY AND CONDITIONS OF EMPLOYMENT AND RESCINDING RESOLUTION NO. 9669 WHEREAS, Resolution No. 9669 fixed the salary of the City Attorney, effective as of October 23, 1979; and WHEREAS, the office of the City Attorney became vacant on September 18, 1981; and WHEREAS, the City Council. has advertised and invited applications to fill this vacancy; and WHEREAS, the City Council, after interviewing several qualified applicants, now desires to make a permanent appointment to that office, and has subsequently offered the position of City Attorney to MICHAEL H. MILLER, subject to certain terms and conditions of employment it has the power and duty to fix, which are as follows: 1. Salary A starting annual salary of $61,153.00; 2. Working Hours The City Attorney will devote whatever time may be necessary to perform his job adequately; 3. Vacation & Sick Leave The City Attorney is to receive the same vacation and sick :Leave benefits afforded other employees of the City; 4. Retirement The City Attorney is to receive the same retirement benefits afforded other City employees of the miscellaneous category of the California State Employee's • Retirement System; 5. Training & Attendance at Conferences With approval of the City Council for out -of -town functions, the City Attorney will be permitted to attend a reasonable number of professional meetings, institutes and conferences; r -I A 6. Health Insurance 6 Life Insurance The City Attorney is to receive the same health and life insurance benefits as afforded other employees of the City; 7. City Car An arrangement for transportation will be made that is mutually satisfactory to the City Council and City Attorney; S. Special Allowances The City Attorney will be permitted to join professional organizations, such as the National Institute of Municipal Law Officers, with said dues being a charge against the City of Newport Beach; 9. Moving Expenses The City shall provide expenses for moving of household furnishing: to the Newport Beach area, provided the expenses do not exceed $1,000.00. It is agreed that if the City Attorney, at his option, terminates his employment, prior to two years from the date of employment, he will repay the moving expenses referred to herein; and WHEREAS, a letter of acceptance, dated December 4, 1981, from MICHAEL H. MILLER, accepting the offer of employment as City Attorney for the City of Newport Beach, subject to the above terms and conditions, has been received by the City Council, and is attached hereto as Exhibit "A." NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach, that pursuant to Chapter 602 of the Charter of the City of Newport Beach, the acceptance of appointee and the terms and conditions herein. recited, MICHAEL H . MILLER be and hereby is appointed City Attorney for the City of Newport Beach, effective January 18, 1982. 2 BE IT FURTHER RESOLVED that Resolution No. 9669 be and hereby is rescinded, effective January 18, 1982. • ADOPTED this 14th day of December , 1981. Prior to that date.I shall have reviewed various materials per- taining to the City such as your municipal code and Charter. Of course, I envision full access to the Council and Council(nembers with regard to your concerns and interests on behalf of the City of Newport Beach.
