A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH DECLARING CITY'S INTENTION TO VA-
CATE A PORTION OF AN EXISTING 14 FT. ALLEY;
ACCEPTING A MAP SHOWING THE PORTION OF ALLEY PRO-
POSED TO BE VACATED AND SETTING MAY 10, 1982, AS
• THE DATE FOR A PUBLIC HEARING CONCERNING THE IN-
TENDED VACATION (NE OF E. COAST HGWY BETWEEN IRIS
& ALLEY W OF IRIS IN BLOCK 535, CDM TR) (RESUB
721)
WHEREAS, the City Council of the City of Newport Beach,
pursuant to the provisions of the Street Vacation Act and all
amendments thereto, being Sections 8300 to 8325 and 8340 to 8353
inclusive, of the Streets and Highways Code of the State of
California, provides for the vacation of easements; and
WHEREAS, the Planning Commission of the City of Newport
Beach, on March 18, 1982, as a condition of approval in connec-
tion with Resubdivision No. 721, required that subject alley be
vacated prior to the issuance of any Building Permits; and
WHEREAS, the subject alley is presently unimproved with
no access from adjacent property owners; and
WHEREAS, all utilities have been notified and the
Southern California Edison Company has requested that an easement
be retained for their facilities, which easement will be reserved
over that portion to be vacated; and
WHEREAS, the alley to be vacated is shown on a two -page
map attached hereto marked Exhibit "A" and incorporated herein by
reference; and
WHEREAS, proceedings for the: vacation of the above-
described alley shall be undertaken by the City Council of the
City of Newport Beach, pursuant to the provisions of the Street
Vacation Act of 1941 and all amendments thereto, being Sections
8300 and 8325 and 8340 to 8353 inclusive, of the Streets and
• Highway Code of the State of California;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that notice is hereby given that the
City Council of the City of Newport Beach does hereby fix May 10,
1982, at the hour of 7:30 p.m. of said day, in the City Council
Chambers of the City of Newport Beach, located at 3300 Newport
• Boulevard, Newport Beach, California, as the time and place for
hearing all persons interested in or objecting to the proposed
vacation of said alley, and the City Council at said time and
place will hear the evidence offered by any person interested in
the vacation of said alley, hereinbefore described.
BE IT FURTHER RESOLVED that this Resolution of
Intention shall be published at least: once in the official news-
paper of the City, and said publication shall be made before the
date set for the hearing of all persons interested in or object-
ing to the proposed vacation.
