A RESOLUTION OF THE CITY COUNCIL OF THE CITY
• OF NEWPORT BEACH AUTHORIZING THE CLOSURE OF
21ST PLACE BETWEEN OCEANFRONT AND MC FADDEN
PLACE TO VEHICULAR TRAFFIC AND DIRECTING THE
CITY CLERK TO RECORD SAME WITH THE ORANGE
COUNTY RECORDER

WHEREAS, Vehicle Code Section 21101 authorizes the
closing of any highway (street) to vehicular traffic when the
legislative body determines that it is no longer needed for such
traffic; and
WHEREAS, the City of Newport Beach Public Works
Department has determined that subject to certain rules and
regulations, said highway is no longer needed for vehicular
traffic; and
WHEREAS, this subject finding is predicated on the
satisfaction of various conditions as set forth herein.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach, resolves as follows:
1. The area between 21st Place between Oceanfront and Mc
Fadden, as set forth in the attached, subject to
satisfaction of the conditions set forth herein, is no
longer needed for vehicular traffic; and
2. Upon satisfaction of the conditions set forth below,
subject highway shall be closed for vehicular traffic
consistent with the rules and regulations provided in
this Resolution;
3. The following rules and regulations are hereby set forth
as conditions to the closure of subject street:
(a) Emergency and utility vehicles shall be allowed
access as needed for emergencies and repairs; and

(b) A 12 ft. - wide clear area shall be maintained on
21st Place for emergency and utility vehicular
access; and
• (c) That Mr. Richard Lee Lawrence and /or adjoining •
property owners agree to construct and maintain the
non - standard improvements at no cost to the City of
Newport Beach; allow for installation of a fire
hydrant at 21st Place and Ocean Front and agree to
indemnify and hold the City of Newport Beach
harmless from any liability arising from or related
to closure of said street to vehicular traffic and
addition of said non - standard improvements.
(d) The City Council is not precluded from repealing
this Resolution and returning said street to its
vehicular status at any time. Adjacent property
owners shall execute an acknowledgement consistent
with this possibility.
BE IT FURTHER RESOLVED that the City Clerk be and
hereby is directed to file this Resolution with the Recorder in
and for the County of Orange.
