that the City Council, upon recommendation by the Planning Commission, may
amend the General Plan, or any part or element thereof; and
WHEREAS, as part of the development and implemention of the City's
General Plan, the Land Use and Residential Growth Elements have been prepared;
and
WHEREAS, said elements of the General Plan set forth objectives and
supporting policies which serve as a guide for the future development of the
City of Newport Beach; and
WHEREAS, pursuant to Section 707 of the Charter of the City of Newport
Beach, the Planning Commission has held a public hearing to consider certain
amendments to the above referenced elements of the Newport Beach General Plan
and adopted Resolution No. 1101, recommending to the City Council certain
changes and amendments in said elements; and
WHEREAS, the City of Newport Beach has, in the General Plan Housing
Element, established policies to increase the production of housing in the
community and to provide affordable housing opportunities in the City; and
WHEREAS, the City recognizes its responsibility to designate sufficient
vacant land for residential use with appropriate standards to produce housing
at the lowest possible cost consistent with Section 65913 of the Government
Code; and
WHEREAS, it is the goal of the City to provide a balanced community, with
a variety of housing types and designs and housing opportunities for all
economic segments of the community; and
WHEREAS, it is the goal of the City to preserve and increase affordable
• housing for low and moderate income households; and
WHEREAS, it is the policy of the City to eliminate constraints to housing
production and increase allowed density, wherever possible; and
WHEREAS, it is the policy of the City to provide incentives to the
building industry to facilitate the provision of housing for low and moderate
income households; and

BEACH APPROVING CERTAIN PROPOSED AMENDMENT TO
THE LAND USE
AND RESIDENTIAL GROWTH ELEMENTS OF THE NEWPORT
BEACH GENERAL
PLAN, AND IN
APPROVING SAID AMENDMENTS MARE
THE FINDINGS
LISTED BELOW
IN REGARDS TO THE ENVIRONMENTAL
DOCUMENTATION
(GENERAL PLAN
AMENDMENT 83- 1(e)).
•
WHEREAS, Section
707 of the Charter of the City of Newport Beach provides
that the City Council, upon recommendation by the Planning Commission, may
amend the General Plan, or any part or element thereof; and
WHEREAS, as part of the development and implemention of the City's
General Plan, the Land Use and Residential Growth Elements have been prepared;

WHEREAS, the City of Newport Beach recognizes the unique opportunity to
provide affordable housing in Newport Center; and
WHEREAS, the increased residential use in Newport Center will result in a
mixed use development that achieves a balance between residential and
appropriate commercial activities; and
isWHEREAS, the increased residential use in Newport Center will achieve an
appropriate balance between employment and housing; and
WHEREAS, the increased residential use in Newport Center will promote and
assist in the development of housing for low and moderate income households;
and
WHEREAS, the increased residential use in Newport Center will promote
housing opportunities for all persons regardless of race, religion, sex,
marital status, ancestry, national origin, or color; and
WHEREAS, the increased residential use in Newport Center will provide for
the development of a variety of housing types and products for all income
levels of the community; and
WHEREAS, the City of Newport Beach recognizes the opportunity to require
provision of affordable housing either on or off -site in conjunction with
residential development in the City; and
WHEREAS, the use of Community Development Block Grant funds in
conjunction with this project will contribute to the feasibility of providing
affordable housing on -site; and
WHEREAS, an Initial Study has been prepared in compliance with the
California Environmental Quality Act, and the CEQA guidelines; and
WHEREAS, a Final Environmental Impact Report was prepared in conjunction
with General Plan Amendment 80 -3; and
WHEREAS, the Final Environmental Impact Report was certified as adequate
by the City Council on August 31, 1981; and
WHEREAS, the Final Environmental Impact Report fully and adequately
discusses the environmental impacts associated with increased development in
Newport Center; and

WHEREAS, the project proposed in General Plan Amendment 83 -1(e) was
analyzed as an alternative to the project analyzed in the Final Environmental
Impact Report; and
WHEREAS, based upon information contained in the Initial Study, there are
no new significant environmental impacts that were not considered in the prior
certified Final EIR; and

WHEREAS, all measures necessary to mitigate the environmental impacts
associated with the approved project have been incorporated into the project.
NOW, THEREFORE, BE IT RESOLVED that -the City Council of the City of
Newport Beach finds the previously prepared EIR is adequate for the project at
• hand, and that the following amendments to the Land Use and Residential Growth
Elements be approved as follows:
1. 428 additional residential units: are permitted in Newport
Center.
2. Of the 428 additional units, 150 shall be units allocated to
the Newport Village Site and shall be affordable to families of
low and moderate income. Of the 150 affordable units, 808
(120) shall be affordable to families whose income does not
exceed 1008 of the Orange County median family income and 208
(30) shall be affordable to families whose income does not
exceed 808 of the Orange County median family income. These
units shall be maintained as affordable for ten (10) years from
the date of original occupancy. Dependent on the availability
of Mortgage Revenue Bond Financing and CDBG funds, the City
will determine the mix of ownership and rental affordable
housing.
3. Of the 428 additional units, 278 will be permitted on any site
in Newport Center, subject to approval of the City.
4. The 278 additional market rate units to be built in Newport
Center shall be phased with the construction of 150 units in
Newport Village, 60 units at 5th and MacArthur, and 68 units in
Baywood affordable to low and moderate income households.
5. That prior to the approval of any of the additional 428 units,
the City and The Irvine Company shall enter into a development
agreement for provision of affordable housing units and for the
phasing of development with circulation system improvements.
6. That the project shall comply with the park dedication
ordinance. Prior to approval of Tentative Tract Maps for the
additional units in Newport Center, the City shall determine
the appropriate means for satisfaction of the park dedication
requirements.
7. At the time of future discretionary approvals the project shall
be required to contribute a sum equal to its fair share of
future circulation system improvements as shown on the City's
Master Plan of Streets and Highways and any other mitigation
measures as required.
