A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF NEWPORT BEACH ADOPTING LOCAL COASTAL
PROGRAM AMENDMENT NO. 45 AMENDING THE LOCAL
COASTAL PROGRAM LAND USE PLAN OF THE CITY OF NEWPORT
BEACH SO AS TO ALTER THE BOUNDARY BETWEEN THE "RETAIL, SERVICE
COMMERCIAL" USE AND THE "SINGLE- FAMILY RESIDENTIAL " USE
(LCP Amendment No. 45)
• WHEREAS, the Coastal Act of 1976 requires the City of Newport to prepare a local
coastal program; and
WHEREAS, as part of the development and implementation of the Coastal Act, a
Local Coastal Program Land Use Plan has been prepared; and
WHEREAS, said Land Use Plan sets forth objectives and supporting policies which
serve as a guide for future development in coastal areas of the City of Newport Beach; and
WHEREAS, the Planning Commission has held a duly noticed public hearing to
consider a certain amendment to the Land Use Plan of the Newport Beach Local Coastal Program; and
WHEREAS, in conjunction with the consideration of the above referenced
amendment to the Land Use Plan of the Local Coastal Program, it has been determined to be
Categorically Exempt from the provisions of the California Environmental Quality Act (CEQA) under
Class 5 (Minor Alteration in Land Use), inasmuch as the proposed changes are consistent with the
exchange of land made in conjunction with the approval ofResubdivision No. 1019.
NOW, THEREFORE BE IT RESOLVED, by City Council of the City of Newport
Beach that Local Coastal Program Amendment No. 45 to the Land Use Plan Map, is recommended to
the City Council for approval as follows:
That the properties located at 3901 East Coast Highway and 352 Hazel Drive, more
particularly described as Parcels No. 1, 2 and 3 of Parcel Map No. 95 -178
(Resubdivision No. 1019), located on the northeasterly comer of East Coast Highway
and Hazel Drive, the boundary is to be altered between the "RETAIL AND SERVICE
COMMERCIAL" use and the "SINGLE- FAMILY DETACHED" residential use.
