A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH SUMMARILY VACATING A PORTION OF GLEN DRIVE FROM
THE NORTHEASTERLY BOUNDARY OF LOT 68, TRACT 673 TO THE
POINT OF INTERSECTION WITH EAST COAST HIGHWAY.
WHEREAS, the City Council of the City of Newport Beach, pursuant to the
provisions of the Street Vacation Act (Section 8300 at sec. of the Streets & Highways
Code) is authorized to summarily vacate Public Easements; and
WHEREAS, the City Council has determined that the portion of Glen Drive
from the northeasterly boundary of Lot 68, Tract No. 673 to the point of intersection with the
southerly right -of -way line of East Coast Highway (the Public Easement) is not currently,
and will not be in the future, necessary for public use or access;
WHEREAS, the City Council has reviewed and considered the various
elements of the General Plan of the City of Newport Beach and has determined that the
proposed vacation of the Public Easement is consistent with the General Plan and other
policies, ordinances, and resolutions of the City of Newport Beach; and
WHEREAS, the City Council has previously vacated that portion of Glen
Drive southerly and westerly of the northeasterly boundary of Lot 68, Tract 673 pursuant to
Resolution No. 92 -9; and
WHEREAS, the City Council has determined that vacation of the Public
Easement would not cut off all access to any person's property which, prior to vacation,
joined Glen Drive; and
WHEREAS, vacation of the Public Easement would not terminate any Public
Service Easement; and

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT

WHEREAS, the Public Easement has not been used for public access or any
other public purpose for a period of five (5) consecutive years immediately preceding this
vacation and, Glen Drive has been impassable for vehicular travel for a period of five (5)
• consecutive years preceding this vacation; and
WHEREAS, from and after the date this Resolution is recorded, the Public
Easement no longer constitutes a street, highway or public service easement.
NOW, THEREFORE, be it resolved by the City Council of the City of Newport
Beach that the portion of the Public Easement (Glen Drive) legally described in Exhibit "A ",
and depicted on the map attached as Exhibit "B" is hereby ordered to be summarily vacated
and abandoned.
BE IT FURTHER RESOLVED that the City Clerk is hereby directed to have
this resolution recorded by the Orange County Recorder.
