A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH APPROVING DESTRUCTION OF
CERTAIN POLICE DEPARTMENT RECORDS
• WHEREAS, Government Code Section 34090 provides that with the approval of
the City Council by a Resolution and the written consent of the City Attorney, the head of
a City department may destroy any City record, document, instrument, book or paper,
under his or her charge, without making a copy after the same is no longer required; and
WHEREAS, the Newport Beach Police Department currently maintains personnel
related reports and investigations for a period of time in excess of five (5) years; and
WHEREAS, it has been determined that many personnel related reports and
investigations contain documents and other information no longer valuable or necessary
to the Newport Beach Police Department or of interest to the Department of Justice and
which are no longer required to be maintained pursuant to any other law or statute.
NOW, THEREFORE, be it resolved by the City Council of the City of Newport
Beach as follows:
1. Documents meeting the below described criteria may be destroyed as
directed by the Chief of Police, without making a copy and no longer maintained by the
Newport Beach Police Department:
a. Personnel investigations that are five (5) years old or older shall be purged
from the file and destroyed.
b. Traffic collision reports that are five (5) years old or older shall be purged
from the file and destroyed.
C. Topical files, including administrative investigations, two (2) years old or
older shall be purged from the file and stored in property for a period of three (3) years at
• which time they shall be destroyed.
d. Personnel files of employees who have resigned, retired or have been
dismissed shall be maintained in the office of the Chief of Police for a period of three (3)

years. Inactive employee files that are three (3) years old shall be removed from the
office of the Chief of Police and stored in property for a period of ten (10) years in storage.
