• A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NEWPORT BEACH
ESTABLISHING A SCHEDULE OF FEES TO
BE CHARGED FOR SPECIFIC SERVICES
WHEREAS, the City of Newport Beach retained KPMG Peat Marwick LLP
(KPMG) to conduct a cost of services study for City services requested and initiated by
residents, businesses and others who are most benefited by the service; and
WHEREAS, the KPMG study determined the actual cost of providing the services
including direct labor costs, administration or "overhead" costs and the cost of materials
and supplies; and
WHEREAS, City staff has reviewed the cost determinations resulting from the
KPMG study and made recommendations to the City Council Finance Committee
concerning the extent of cost recovery; and
WHEREAS, the Finance Committee reviewed the KPMG study and the actual
• cost recovery recommendations of City staff and made their recommendations to the City
Council; and
•
WHEREAS, the City Council at their regular meeting of February 10, 1997
adopted Ordinance 97 -8 establishing cost recovery percentages for the specific services;
and
WHEREAS, fees for services may recover up to 100% of the cost of providing the
service as a service cost reimbursement; and
WHEREAS, the schedule of fees in EXHIBIT "A" represents a reasonable
reimbursement for the actual costs incurred by the City of Newport Beach to provide
services requested by residents, businesses and others, but, does not recover more than
100% of the actual cost incurred; and
WHEREAS, Ordinance 97 -8 authorizes the City Council to establish late fees and
interest to be paid by users of services who fail to pay fees when due.
NOW, THEREFORE, the City Council of the City of Newport Beach resolves as
follows:

Section 1: The schedule of fees for services attached to this Resolution as
• EXHIBIT "A" is hereby adopted.
Section 2: If fees for services are not paid when due, then in addition to the fees
for services a late payment penalty in the amount equal to ten percent (10 %) of the unpaid
amount shall be imposed. If fees for services remain unpaid for thirty (30) days from the
date due, a second late payment penalty in the amount equal to ten percent (10 %) of the
unpaid amount shall be imposed. The second late payment penalty shall be in addition to
the first late payment penalty. In addition, interest shall be imposed on all unpaid fees for
services at the rate of ten percent (10 %) per annum or the legal rate allowed, whichever is
less, from the date the fees were due and payable to the date actually paid.
Section 3: Resolution numbers 91 -70, 96 -42, 91 -66, 94 -34, and 93 -32, are hereby
amended as necessary to reflect the applicable fees in EXHIBIT "A ".
Section 4: Resolution numbers 91 -42, 94 -51, 94 -97, 95 -39, 89 -11, 96 -38, 95 -59,
94 -103, 91 -63 and 92 -54 are hereby rescinded.
Section 5: This Resolution shall take effect upon the effective date of Ordinance
97 -8.
Passed and adopted by the City Council of the City of Newport Beach at the
• regular meeting held on the 10th day of February, 1997.

BUILDING DEPARTMENT
204.3 Fee for an appeal hearing before the Board of Appeals. The fee for an appeal
hearing before the Board of Appeals are hereby established to be Six Hundred Thirty Dollars
($630.00), payable at the time the applicant submits his request for a hearing. Should the
applicant desire to withdraw his request 24 hours prior to a public hearing, the Building Official
may authorize refunding of up to 80% of the fee paid.
SECTION 304 - FEES
Sec. 304.1 General. Fees shall be assessed in accordance with the provisions of this
section or shall be as set forth in the fee schedule adopted by this jurisdiction. All hourly costs
include equipment, hourly wages and fringe benefits of employees involved.
• Sec. 304.2 Permit Fees. The fee for each permit shall be as set forth in Tables 3 -A
through 3 -I. Where a technical code has been adopted by the jurisdiction for which no fee
schedule is shown in this code, the fee required shall be in accordance with the schedule
established by the legislative body.
The determination of value or valuation under any of the provisions of these codes shall
be made by the building official. The value to be used in computing the building permit and
building plan review fees shall be the total value of all construction work for which the permit is
issued as well as all finish work, painting, roofing, electrical, plumbing, heating, air conditioning,
elevators, fire extinguishing systems and other permanent equipment.
Sec. 304.3 Plan Review Fees: When a plan or other data are required to be submitted by
Section 302.2, a plan review fee shall be paid at the time of submitting plans and specifications
• for review. The plan review fee for buildings or structures shall be 72 percent of the building
• permit fee as shown in Table No. 3 -A plus the following additional plan check fees where
compliance with state regulations is required.

The plan review fees for electrical, mechanical and plumbing work shall be equal
to 25 percent of the total permit fee as set forth in Table No's. 3 -B, 3 -C and 3 -1), respectively.

The plan review fee for grading work shall be as set forth in Table
The plan review fees specified in this subsection are separate fees from the permit
fees specified in Section 304.2 and are in addition to the permit fees.
When plans are incomplete or changed so as to require additional plan review, an
additional plan review fee shall be charged at the rates shown in Table No's. 3 -A through 3 -G.
Sec. 308.2 Temporary Utility Connections
Fee. The Building Official shall require that a bond be posted for the temporary energizing of the
building's electrical or gas piping system provided (a) that the inspector finds the system safe and
authorized the connection and (b) that this temporary use does not exceed 60 days. The amount of the
bond for a single family residence shall be $500.00. For all other occupancies the bond shall be
$1,000.00 for each Service meter. In addition, an inspection fee as specified in Table 3 -B and 3 -D may
• be required.

SET -UP FEES:
Set -up fees of all facilities incur a charge of $30 per rental; with the exception of OASIS Multi- Purpose
Room, $80, the gymnasiums, $50, and the Central Library Community Room, $60.
OASIS: Rentals of the OASIS Senior Center must be approved by the OASIS Senior Recreation Manager
prior to Community Services Department approval. Certain restrictions apply to this facility that the OASIS
staff will discuss with potential renters.
INSURANCE: Certain facilities or activities are subject to insurance requirements such as the rental of the
Peninsula Park Gazebo with the use of amplified sound.
GENERAL RESTRICTIONS:
