A RESOLUTION OF THE CITY OF NEWPORT BEACH TO
CONDITIONALLY SUPPORT THE EVALUATION OF
RESTRUCTURING ALTERNATIVES
OF COASTAL MUNICIPAL WATER DISTRICT
AND
MUNICIPAL WATER DISTRICT OF ORANGE COUNTY
WHEREAS, the "wholesale" delivery of water in Orange County includes
production and delivery of local water supplies, as well as the delivery of
imported water supplied by the Metropolitan Water District of Southern California
( "MWD "); and
WHEREAS, the wholesale delivery of imported MWD water in the coastal
portion of Orange County stretching from Newport Beach to San Clemente has
been accomplished through Coastal Municipal Water District ( "CMWD ") for over
• fifty (50) years; and
WHEREAS, City of Newport Beach ( "City ") as a member agency of
CMWD, receives imported MWD water through CMWD for delivery to its
customers; and
WHEREAS, various governmental restructuring, reorganization and
consolidation proposals have been recommended for the future wholesale
delivery of local and imported water in the CMWD service area, including: 1) the
proposed consolidation of CMWD and the Municipal Water District of Orange
County ( "MWDOC") and 2) the creation of a North and South County Wholesale
District divided by basin and non -basin agencies; and
WHEREAS, this City has recently participated in a series of "facilitated
meetings" among CMWD, MWDOC and other CMWD / MWDOC member
agencies to determine whether or not the proposed consolidation of CMWD and
MWDOC would be appropriate; and
• WHEREAS, now that those facilitated meetings have been completed,
CMWD has requested that the City formally review, analyze and consider the

• issues associated with the proposed consolidation of CMWD and MWDOC and
adopt a resolution in support of or opposition to: 1) the consolidation of CMWD
and MWDOC; and /or 2) the reorganization of CMWD and MWDOC into a North
and South County Wholesale District; and
WHEREAS, the City has reviewed the information produced during the
facilitated meetings and independently analyzed the impact that such
restructuring proposals may have on the continued availability to the City of a
reliable and economical water supply; and
WHEREAS, the City has determined that the proposed restructuring
proposals could result in increased services with a possible cost savings for the
City or for the citizens served by the City; and
WHEREAS, the City has determined that the following conditions should
be considered by LAFCO during the process of evaluating any of the
restructuring alternatives for CMWD and MWDOC:

Single Orange County Wholesale District (Consolidation of CMWD and
MWDOC)
1. The consolidated agency should have at least seven board
members with one member from Coastal.
2. The Coastal area would become an election division for a board
member.
3. Maintain the current total of seven MWD directors between CMWD
and MWDOC by MWD adopting a policy to preserve the current
representation level.
4. At least two of the seven MWD directors should be from Coastal
during the time the consolidated agency has seven MWD directors.
A minimum of one, should be from Coastal, if MWD directors are
reduced to six.
5. The Manager's Advisory Committee should be increased from ten
• to twelve members with two from the Coastal area - -one from the
North and one from the South.

• 6. That our costs do not increase as a result of consolidation or
reorganization and they should preferably decrease.
7. Preservation of the Laguna Declaration Policy to provide service to
the existing Coastal boundaries.
a. After consolidation, a new entity shall be considered as a surviving
agency.
9. Preserve the existing capacity rights that the existing agencies
have in transmission feeders serving the coastal service area.
Creation of a North and South Countv Wholesale District
1. Maintain the current total of seven MWD directors between CMWD
and MWDOC by MWD adopting a policy to preserve the current
representation level.
2. That our costs do not increase as a result of consolidation or
• reorganization and they should preferably decrease.
3. Preservation of the Laguna Declaration Policy to provide service to
the existing Coastal boundaries.
4. Preserve the existing capacity rights that the existing agencies
have in transmission feeders serving the coastal service area.
WHEREAS, the City requests that a status quo option be evaluated in the
review process that would leave CMWD and MWDOC unchanged.
NOW, THEREFORE, BE IT RESOLVED that the City of Newport Beach
(City) does hereby support: (A) Evaluation of both alternatives with the conditions
described above: 1) the proposed consolidation of CMWD and MWDOC, and 2)
the creation of a North and South County Wholesale District, and request that
the Orange County Local Agency Formation Commission (LAFCO) provide the
• appropriate and necessary terms and conditions; and (B) As part of the review
process, an evaluation of the status quo option by LAFCO.

• BE IT FURTHER RESOLVED that the City shall deliver a certified copy of
the Resolution to the following: the Coastal Municipal Water District, the
member agencies of Coastal Municipal Water District, the Municipal Water
District of Orange County and the Local Agency Formation Commission.
