• A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH APPROVING AN UPDATED RECREATION
AND OPEN SPACE ELEMENT OF THE GENERAL PLAN
[GENERAL PLAN AMENDMENT 94 -2 (E)]
WHEREAS, pursuant to Section 65302 of the California Government Code, the City of
Newport Beach is required to prepare and adopt an open space element; and
WHEREAS, the Recreation and Open Space Element of the General Plan has not been
comprehensively updated since it was adopted in 1988; and
WHEREAS, a comprehensive update of the Recreation and Open Space Element of the
General Plan is necessary in order to establish the objectives, principles, standards, and plan
proposals for open space and recreation facilities in the City of Newport Beach; and
WHEREAS, on May 7, 1998, the Planning Commission of the City of Newport Beach
• held a public hearing regarding the updated Recreation and Open Space Element; and
WHEREAS, on June 22, 1998, the City Council of the City of Newport Beach held a
public hearing regarding updated Recreation and Open Space Element; and
WHEREAS, the public was duly noticed of these public hearings; and
WHEREAS, Pursuant to the California Environmental Quality Act an Initial Study has
been conducted to evaluate the potential environmental impacts of the proposed project. The
Initial Study concluded that the project could not have a significant effect on the environment;
therefore, a Negative Declaration has been prepared.
THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DOES HEREBY RESOLVE
AS FOLLOWS:
SECTION 1: General Plan Amendment 94 -2 (E) is hereby approved to comprehensively
• update the Recreation and Open Space Element of the General Plan, as provided in Exhibit "A."
SECTION 2: That based upon the information contained in the Initial Study, comments
• received, and all related documents, the City Council finds that there is no substantial evidence that
the project, as conditioned or as modified by mitigation measures identified in the Initial Study,
•
could have a significant effect on the environment, therefore a Negative Declaration has been
prepared. The Negative Declaration adequately addresses the potential environmental impacts of
the project, and satisfies all the requirements of CEQA, and is hereby approved. The Negative
Declaration reflects the independent judgement of the City Council and was reviewed and
considered prior to approval of the project.
This resolution was adopted at a regular meeting of the City Council of the City of
Newport Beach held on June 22, 1998, by the following vote, to wit:

I, LAVONNE M. HARKLESS, City Clerk of the City of Newport Beach, California, do
hereby certify that the whole number of members of the City Council is seven; that the foregoing
resolution, being Resolution No. 98 -49, was duly and regularly introduced before and adopted by the
City Council of said City at a regular meeting of said Council, duly and regularly held on the 22nd
day of June, 1998, and that the same was so passed and adopted by the following vote, to wit:
