A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH
RELATING TO DESIGNATING A REPRESENTATIVE TO SIGN A PROPOSITION 40
AGREEMENT, AND ANY AMENDMENTS THERETO, FOR THE NEWPORT ISLAND
CHANNELS CIRCULATION IMPROVEMENT PROJECT (Project)
WHEREAS, voters of the State of California passed Proposition 40 (the
Watershed, Clean Beaches and Water Quality Act of 2002) in September 2002; and
WHEREAS, the City Council of the City of Newport Beach supported the passage
of Proposition 40 in 2002; and
WHEREAS, Proposition 40 Phase II includes $22.2 M in funding for various
programs and measures to implement projects that protect and restore California's
coastal water quality; and
WHEREAS, the City applied for and tentatively received a grant from the State
Water Resources Control Board to address water quality in the Newport Island
Channels area; now, therefore be it
RESOLVED by the City Council of the City of Newport Beach that it hereby:
1. Authorizes the City Manager of Newport Beach to execute an agreement and any
amendments for a Prop 40 Phase II grant relating to the Project; and
2. Certifies that the City has or will have sufficient funds to operate and maintain the
Project; and
3. Appoints the City Manager as agent to conduct all negotiations, execute and submit
all documents including, but not limited to, agreements, amendments, payment
requests, and so on, which may be necessary for completion of the Project.
