A RESOLUTION OF THE CITY COUNCIL OF THE CITYfOF NEWPORT
BEACH ORDERING THE VACATION OF A PORTION OF LA JOLLA DR.
AND DIRECTING THE CITY CLERK TO RECORD SAID RESOLUTION
WITH THE ORANGE COUNTY RECORDER
WHEREAS, the Public Works Director of the City of
Newport Beach has presented to the City Council of the City of
Newport Beach that certain map a copy of which is attached hereto
as Exhibit "A" and incorporated herein by reference which depicts
the portion of La Jolla Dr., right of way proposed to be vacated,
reserving therefrom a slope easement, a storm drain easement and
two public utility easements and as further described in a legal
description, a copy of which is attached hereto as Exhibit "B"
and incorporated herein by reference; and
WHEREAS, the City Council of the City of Newport Beach
has approved and adopted said map and legal description and
directed the City Clerk file same in proceedings for the vacation
and abandonment of the above portion of La Jolla Drive right of
way; and
WHEREAS, on April 9, 1984, the City Council held a
public hearing for purposes of hearing all persons interested in
or objecting to said proposed vacation and abandonment; and
WHEREAS, the City Council finds and determines, from
all of the evidence submitted, that the portion of La Jolla Drive
right of way described herein is unnecessary for present or pros-
pective public use.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that the portion of La Jolla Drive
right of way described herein be and hereby is ordered vacated
and abandoned.
BE IT FURTHER RESOLVED that the City Clerk be and here-
by is ordered to cause a certified copy of such Order, attested
by the Clerk under the seal of the City of Newport Beach, to be
recorded in the Office of the County Recorder of the County of
Orange.

Those portions of La Jolla Drive, 40.00 feet wide, as shown on a map of
Tract No. 444 filed in Book 19, Page 29 of Miscellaneous Maps, Records of
Orange County, California, lying easterly and southeasterly of the centerline
of said La Jolla Drive, more particularly described as follows:
Parcel 1
Beginning at the most northerly corner of Lot 46 of said tract; thence
N 30° O1' 24" W, at right angle from the northwesterly line of said lot,a
distance of 20.00 feet to the centerline of said La Jolla Drive; thence south-
westerly along said centerline.to the northwesterly prolongation of the north-
easterly line of Lot 49 of said tract; thence southeasterly in a direct line
to the most northerly corner of said lot; thence northeasterly along the north-
westerly lines of Lots 48, 47 and 46 of said tract to the point �)f beginning.
Reserving therefrom, an easement for storm drain purposes more particu=
larly described as follows:
Commencing at the most northerly corner of said Lot 46; thence N 300 01'
24" W, at right angle from the northwesterly line of said lot, a distance of
15.00 feet to the True Point of Beginning; thence continuing N 30° 01' 24" W
5.00 feet to said centerline; thence S 590 48' 36" W along said centerline
22.00 feet; thence N 760 53' 54" E to a line parallel with and 15.00 feet
northwesterly, measured at right angles, from the northwesterly line of said
Lot 46; thence N 59° 48' 36" E along said parallel line to the True Point of
Beginning.
Also reserving therefrom, an easement for Southern California Gas
Company facilities more particularly described as follows:
Beginning at the most northerly corner of said Lot 46; thence N 300 01'
• 24" W. at right angle from the northwesterly line of said lot, to a line
parallel with and 15.00 feet northwesterly, measured at right angles, from
said northwesterly line; thence S 590 48' 36" W along said parallel line a
distance of 125.00 feet; thence S 300 01' 24" E, at right angle from said
parallel line, to the northwesterly line of said Lot 48; thence northeasterly
along the northwesterly lines of Lots 48, 47 and 46 to the point of beginning.

Parcel 2
Beginning at the most northerly corner of said Lot 49; thence N 51° 50'
13" W along the northwesterly prolongation of the northwesterly line of said
lot to a non - tangent curve having a radius of 111.60 feet and which is con-
centric to and 15.00 feet northwesterly, measured radially, from that certain
curve having a radius of 96.60 feet in the easterly right -of -way line of said
. La Jolla Drive; thence southerly along said curve through a central angle of
970 23' 49" a distance of 145.91 feet to the westerly prolongation of the
southerly line of Lot 50 of said tract; thence S 680 49' 25" W along said
prolongation to the easterly terminus of that certain curve having a radius
of 25.00 feet in the southerly boundary of said lot; thence westerly and north-
westerly along said curve through a central angle of 580 34' 42" and a distance
of 25.56 feet to the beginning of said 96.60- foot - radius curve in said easterly
right -of -way line of La Jolla Drive; thence along said right -of -way line and
said curve through a central angle 820 45' 08" a distance of 139.52 feet to
the point of beginning.
Reserving therefrom a strip of land, 8.00 feet wide as a slope easement,
the westerly line of which is described as follows:
Beginning at the intersection of the northwesterly prolongation of the
northeasterly line of Lot 49 of said tract and a curve having a radius of
111.60 feet and which is concentric with and 15.00 feet westerly, measured
radially, from that certain curve having a radius of 96.60 feet in the east-
erly right -of -way line of said 4a Jolla Drive; thence southerly along said
curve through a central angle of 970 23' 49" a distance of 145.91 feet to the
westerly prolongation of the southerly line of said Lot 50. The side lines
of said strip of land shall be prolonged or shortened at the beginning so as
to terminate in said northwesterly prolongation of the northeasterly line of
Lot 49 and at the end thereof so as to terminate in said westerly prolongation
of the southerly line of Lot 50.
Also reserving therefrom that portion of a strip of land 35.00 feet wide,
as a public utilities- easement, lying within the above - mentioned Parcel 2
and lying 20.00 feet northerly and 15.00 feet southerly of and adjacent to
the following described centerline:
Beginning at a point in the boundary of Lot 29 of said tract, said point
being the southeasterly terminus of a curve concave northeasterly and having
a radius of 136.60 feet and a length of 7.92 feet; thence northeasterly along
a radial line N 55° 28' 07" E a distance of 40.00 feet to said easterly right -
of -way line of La Jolla Drive.
