RESOLUTION NO. 84 -35
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH DECLARING ITS INTENTION TO VACATE
TICONDEROGA STREET EXCEPTING AREAS RESERVED FOR
EASEMENTS WHICH ARE PROPOSED TO BE VACATED;
SETTING PUBLIC HEARING THEREON
WHEREAS, the City Council of the City of Newport Beach,
pursuant to the provisions of the Street Vacation Act and all
amendments thereto, being Sections 8300 to 8325 and 8340 to 8353
inclusive of the Streets and Highways Code of the State of Cali-
fornia, provides for the vacation of easements; and
WHEREAS, the Newport Crest Homeowners Association has
requested that Ticonderoga Street be vacated so that it could
then become a private street; and
WHEREAS, an agreement has been entered into between the
Newport Crest Howmeowners Association and the Seawind Homeowners
Associaiton to provide for the conversion of Ticonderoga St. into
a private street; and
WHEREAS, all utilities have been notified and a public
utility and public service easement will be retained over Ticon-
deroga St. to allow the City utilities and other ultility access
to operate, maintain and replace their facilities; and
WHEREAS, the City will also reserve a bikeway easement
along Ticonderoga St.; and
follows:
WHEREAS, the area to be vacated is described as
All of that certain street known as Ticondero-
ga Street, 62.00 feet wide, as shown on a map
of Tract No. 7852 filed in Book 302, Pages 7,
8 and 9 of Miscellaneous Maps, Records of
Orange County, California and reserving there-
from a blanket easement for public utlility
purposes, as described on Exhibit "A" attached
hereto; and
WHEREAS, the area to be vacated is described on a one-
page map, a copy of which is attached hereto as Exhibit "B" and
incorporated herein; and
WHEREAS, proceedings for vacation of the above - describ-
ed areas shall be undertaken by the City Council of the City of
Newport Beach, pursuant to the provisions of the Street Vacation
Act of 1941 and all amendments thereto, being Sections 8300 and
8325 and 8340 to 8353 inclusive, of the Streets and Highway Code
of the State of California.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach, that notice is hereby given that the
City Council of the City of Newport 'Beach does hereby fix the
14th day of May , 1984, at the hour of 7:30 p.m. of
said day, in the City Council Chambers of the City of Newport
Beach, located at 3300 Newport Boulevard, Newport Beach, Califor-
nia, as the time and place for hearing all persons interested in,
or objecting to, the proposed vacation proceedings, and the City
Council at said time and place will hear any evidence offered by
any person interested in said vacation; and
BE IT FURTHER RESOLVED that this Resolution of Intent
shall be published at least once in the official newspaper of the
City, and said publication shall be made before the date set for
the hearing of all persons interested in or objecting to the pro-
posed vacation.
