RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH CALLING AND GIVING NOTICE OF THE
HOLDING OF A GENERAL MUNICIPAL ELECTION TO BE
HELD IN SAID CITY ON TUESDAY, NOVEMBER 6,
1984, FOR THE ELECTION OF CERTAIN OFFICERS OF
THE CITY AS REQUIRED BY THE PROVISIONS OF THE
CHARTER AND FOR THE SUBMISSION TO THE
QUALIFIED ELECTORS OF THE CITY OF MEASURES
RELATING TO AMENDMENTS TO THE CITY CHARTER
WHEREAS, under the provisions of the City Charter of
the City of Newport Beach, California, a general municipal
election shall be held on November 6, 1984 for the election of
Municipal Officers; and
WHEREAS, the City Council of the City of Newport Beach
also desires to submit to the qualified electors of the City, at
the election, certain measures relating to proposed amendments to
the City Charter of the City of Newport Beach.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach.
SECTION 1. That pursuant to the requirements of the
Charter of the City of Newport Beach, California, there is called
and ordered held, in the City, on Tuesday, November 6, 1984, a
general municipal election of the qualified electors of the City
for the purpose of electing three members of the City Council of
the City for the full term of four years;
SECTION 2. That the City Council, pursuant to its
right and authority, does order submitted to the qualified
electors of the City at the General Municipal Election to be held
on November 6, 1984, the following measures:

MEASURE 1 - CHARTER AMENDMENT
Measure 1, which proposes an amendment to the City
Charter of the City of Newport Beach, shall appear on the ballot
in substantially the same form, and in substantially the same
• language as follows:
MEASURE 1 - CHARTER AMENDMENT
Shall the City Charter of the City of YES
Newport Beach be amended to change the
date on which the term of a newly elected
Councilmember commences from January 1st NO
to the date on which the Council receives
certification of election results?
A mark placed in the voting square, rectangle or other
specified voting space after the word "YES" in the manner
provided shall be counted in favor of the adoption of the
question. A mark placed in the voting square, rectangle or other
specified voting space after the word "NO" in the manner provided
shall be counted against the adoption of the question.
Should Measure 1 - Charter Amendment receive a
favorable vote and be approved, the following sections of the
City Charter shall be amended to read as follows:
"SECTION 400. ELECTIVE OFFICERS. THE ELEC-
TIVE OFFICERS OF THE CITY SHALL CONSIST OF A
CITY COUNCIL OF SEVEN MEMBERS. CANDIDATES FOR
CITY COUNCIL SHALL BE NOMINATED FROM AND BY
THE ELECTORS OF EACH OF THE SEVEN DISTRICTS
REFERRED TO IN ARTICLE X OF THIS CHARTER AND
ONE SHALL BE ELECTED FROM EACH OF SUCH DIS-
TRICTS BY THE VOTERS OF THE CITY AT LARGE AT
THE TIMES AND IN THE MANNER PROVIDED IN THIS
CHARTER. TIES IN VOTING AMONG CANDIDATES FOR
OFFICE SHALL BE SETTLED BY THE CASTING OF
LOTS.
ALTERNATIVELY, AND SUCCESSIVELY, FOUR FOUR -
YEAR TERMS SHALL BE FILLED AT ONE GENERAL
MUNICIPAL ELECTION AND THREE FOUR -YEAR TERMS
AT THE NEXT SUCH ELECTION, CONSISTENT WITH THE
SEQUENCE OF TERMS OF COUNCILMEMBERS EXISTING
ON THE EFFECTIVE DATE OF THIS AMENDMENT.

THE TERM OF OFFICE SHALL BE FOUR YEARS. THE
TERM OF EACH COUNCIL MEMBER SHALL COMMENCE ON
THE DATE OF THE CITY COUNCIL MEETING,
FOLLOWING HIS OR HER ELECTION, AT WHICH THE
COUNCIL RECEIVES THE CERTIFICATION OF ELECTION
RESULTS FROM THE COUNTY CLERK.
MEASURE 2 - CHARTER AMENDMENT
;• Measure 2, which proposes an amendment to the City
Charter of the City of Newport Beach, shall appear on the ballot
in substantially the same form, and with substantially the same
language as follows:
MEASURE 2 - CHARTER AMENDMENT
Should the City Charter of the City of YES
Newport Beach be amended to change the
date on which the Mayor is selected
from the first Tuesday following any General NO
or Special Municipal Election to the date on
which newly elected Councilmembers are sworn
and qualified?
A mark placed in the voting square, rectangle or other
specified voting space after the word "YES" in the manner
provided shall be counted in favor of the adoption of the
question. A mark placed in the voting square, rectangle or other
specified voting space after the word "NO" in the manner provided
shall be counted against the adoption of the question.
Should Measure 2 - Charter Amendment receive a
favorable vote and be approved, the following sections of the
City Charter shall be amended to read as follows:
SECTION 404. THE MAYOR, MAYOR PRO TEMPORE. ON
THE DATE OF ANY MEETING OF THE CITY COUNCIL AT
WHICH TIME THE COUNCIL RECEIVES THE
CERTIFICATION OF THE RESULTS OF ANY GENERAL OR
SPECIAL MUNICIPAL ELECTION AT WHICH ANY MEMBER
OF COUNCIL IS ELECTED, THE CITY COUNCIL SHALL,
AFTER SWEARING AND QUALIFYING ANY NEWLY
ELECTED MEMBER, ELECT ONE OF ITS MEMBERS AS
ITS PRESIDING OFFICER, WHO SHALL HAVE THE
• TITLE OF MAYOR. THE MAYOR SHALL HAVE A VOICE
AND VOTE IN ALL ITS PROCEEDINGS. THE MAYOR
SHALL HAVE THE PRIMARY BUT NOT EXCLUSIVE
RESPONSIBILITY FOR INTERPRETING THE POLICIES,
PROGRAMS AND NEEDS OF THE CITY GOVERNMENT TO
THE PEOPLE, AND, AS OCCASION REQUIRES, THE
MAYOR MAY INFORM THE PEOPLE OF ANY CHANGE IN
POLICY OR PROGRAM. THE MAYOR SHALL PERFORM
SUCH OTHER DUTIES CONSISTENT WITH THE OFFICE
AS MAY BE PRESCRIBED BY THIS CHARTER OR AS MAY
BE IMPOSED BY THE CITY COUNCIL. THE MAYOR
• SHALL SERVE IN SUCH CAPACITY AT THE PLEASURE
OF THE CITY COUNCIL.
IN ADDITION TO THE PAYMENT FOR EXPENSES AS A
COUNCIL MEMBER UNDER SECTION 402B, THE CITY
COUNCIL MAY PROVIDE BY RESOLUTION FOR THE
PAYMENT TO THE MAYOR OF AN ALLOWANCE OF NOT
EXCEEDING TWO HUNDRED TWENTY DOLLARS ($220.00)
PER MONTH, ADJUSTED ANNUALLY IN ACCORDANCE
WITH THE U.S. DEPARTMENT OF LABOR, BUREAU OF
LABOR STATISTICS, LOS ANGELES, LONG BEACH,
ANAHEIM CONSUMER PRICE INDEX, OR FIVE PERCENT
(5 %) WHICHEVER AMOUNT IS LESSER, TO REIMBURSE
THE MAYOR FOR THE ADDITIONAL EXPENSES INCURRED
IN SERVING IN THAT CAPACITY.
THE CITY COUNCIL SHALL AT THE SAME TIME THE
MAYOR IS ELECTED ALSO DESIGNATE ONE OF ITS
MEMBERS AS MAYOR PRO TEMPORE, WHO SHALL SERVE
IN SUCH CAPACITY AT THE PLEASURE OF THE CITY
COUNCIL. THE MAYOR PRO TEMPORE SHALL PERFORM
THE DUTIES OF THE MAYOR DURING THE MAYOR'S
ABSENCE OR DISABILITY.
SECTION 3. That the ballots to be used at the election
shall be, in form and content, as required by law to be used in
the election.
SECTION 4. That the City Clerk of the City of Newport
Beach is authorized, instructed and directed to procure and
furnish any and all official ballots, notices, printed matter and
all supplies, equipment and paraphernalia that may be necessary
in order to properly and lawfully conduct the election.
SECTION 5. That the polls for the election shall be
open at seven o'clock a.m. of the day of the election and shall
remain open continuously from that time until S o'clock p.m. of
the same day when the polls shall be closed, except as provided
in Section 14301 of the Elections Code of the State of
0 California.
SECTION 6. That in all particulars not recited in this
Resolution, the election shall be held and conducted as provided
by law for holding municipal elections in the City.
SECTION 7. That notice of the time and place of
holding the election is given and the City Clerk is authorized,
instructed and directed to give such further or additional notice
of the election, in time, form and manner as required by law.
SECTION 8. That the City Clerk shall certify to the
passage and adoption of this Resolution and enter it into the
book of original Resolutions.
