A RESOLUTION OF THE CITY COUNCIL OF THE CITY
• OF NEWPORT BEACH, CALIFORNIA, AUTHORIZING
CERTAIN OF ITS MEMBERS TO FILE A WRITTEN
ARGUMENT REGARDING A CITY MEASURE (AND
DIRECTING THE CITY ATTORNEY TO PREPARE AN
IMPARTIAL ANALYSIS)
WHEREAS, a general Municipal election is to held in the
City of Newport Beach, California, on November 6, 1984, at which
there will be submitted to qualified electors of the City the
following measure:
MEASURE 1 - CHARTER AMENDMENT
Shall the City Charter of the City of
Newport Beach be amended to change the
date on which the term of a newly elected
Councilmember commences from January 1st
to the date on which the Council receives
certification of election results?
MEASURE 2 - CHARTER AMENDMENT
Should the City Charter of the City of
Newport Beach be amended to change the
date on which the Mayor is selected
from the first Tuesday following any General
or Special Municipal Election to the date on
which newly elected Councilmembers are sworn
and qualified?
WHEREAS, the City Council wishes to authorize certain
of its members to file a written argument in support of the pro-
posed Charter amendments.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS
FOLLOWS:
SECTION 1. That this City Council, being the legisla-
tive body of the City of Newport Beach, authorizes
Mayor Pro Tem Maurer, Council Members Heather and Strauss , members of
that body, to file a written argument (in favor of /against) the
City measure set forth in the recitals hereof in accordance with
Article 4, Chapter 3, Division 5 of the Elections Code of the
State of California and to change the argument until and includ-
ing the date fixed by the City Clerk after which no arguments for
or against the City measure may be submitted to the City Clerk.
•SECTION
2.
That
the City Council
directs
the City
Clerk to transmit
a
copy of
the measure to
the City
Attorney.
The City Attorney shall prepare an impartial analysis of the
measure showing the effect of the measure on the existing law and
the operation of the measure. The impartial analysis shall be
filed by the date set by the City Clerk for the filing of primary
arguments.
