A RESOLUTION OF THE CITY COUNCIL OF THE,
CITY OF NEWPORT BEACH, CALIFORNIA,
ORDERING CERTAIN CHANGES AND MODIFICA-
TIONS IN PROCEEDINGS AND ASSESSMENTS
IN AN ASSESSMENT DISTRICT PURSUANT TO
THE "MUNICIPAL IMPROVEMENT ACT OF 191311,
BEING DIVISION 12 OF THE STREETS AND
HIGHWAYS CODE OF THE STATE OF CALIFORNIA
WHEREAS, the CITY COUNCIL of CITY OF NEWPORT BEACH, CALIFORNIA, has
previously adopted its Resolution of Intention pursuant to the provisions of the
"Municipal Improvement Act of 191311, being Division 12 of the Streets and Highways
Code of the State of California, for the construction of certain works of improvement
in a special assessment district known and designated as
ASSESSMENT DISTRICT NO. 56
(CHINA COVE)
(hereinafter referred to as the "Assessment District "); and
WHEREAS, subsequent thereto, the City Council did, by Resolution, approve
the "Report" and call for sealed bids for the sale of bonds as contemplated in said
Assessment District; and,
WHEREAS, prior to said Public Hearing, sealed bids were received and consi-
dered for the sale of bonds for the Assessment District, and based on the recommenda-
tions therefor and other adjustments in the estimated costs, it is now determined
that assessments can be amended and modified accordingly; and, .
WHEREAS, the City Council has determined that the City's contribution to
the Assessment District should be increased to $24,674.92, thus allowing further
modifications to the assessments; and,
WHEREAS, it now appears that certain changes and modifications as set forth
in the amended assessment roll should be approved and ordered to be done.
NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS:
SECTION 1. That the above recitals are all true and correct.
SECTION Z. That it is hereby ordered that the changs and modifications as
set forth in the amended assessment roll as presented herein, based on the bids
received, adjustments in costs and the increased City contribution, are hereby
approved and ordered to be done.
SECTION .3. That said changes and modifications above mentioned are hereby
ordered pursuant to the authority as set forth in Section 10352 of the Streets and
Highways Code of the State of California (the "Municipal Improvement Act of 1913 ").
SECTION 4. That the Engineer's "Report ", the Assessment Roll, and all
related documentation, as so modified, are all for the best interests of the property
• owners within the Assessment District, and said assessment, as modified and appor-
tioned, is in accordance with the benefits received, and the "Report ", as herein
modified and amended, shall stand as the "Report" for all subsequent proceedings
relating to this Assessment District.
SECTION 5. That the staff is hereby directed to provide for a hardship
loan program for qualified property owners owning property within the boundaries of
the Assessment District. The terms and conditions of any such loan shall be incor-
porated in such agreement with the property owner as deemed appropriate and shall be
subject to review and approval by the City Council.

Council held on the 24th day of September 1984, and that the same was
passed and adopted by the following vote:
